Narrative:
We were told to climb and maintain 14000 ft MSL by washington approach. We heard that air carrier Y airlines mj-80 was cleared to 12000 ft. It appeared that approach was having a hard time communicating with the air carrier Y jet. We could hear the agitation in the controller's voice. He then came back and asked us what altitude we were at. We told him we were climbing through 12800 ft. He told us to descend back down to 12000 ft. During the descent, the TCASII warned us of traffic. I looked down and saw that we were descending on top of an air carrier Y jet. We once again called approach on 126.55 and told him to verify our assigned altitude. He then told us we were supposed to be at 14000 ft. We climbed back up to 14000 and the controller finally vectored us back to the ami 091 degree radial. The TCASII did not have us respond to the conflict. I believe if the air carrier Y jet would have communicated better, this would have been avoided. Also, there was a lot of radio congestion.

Title: ATC CTLR RECLRED MDT BACK DOWN TO A NEW ASSIGNED ALT CAUSING IT TO CONFLICT WITH A CLBING MLG.
Narrative: WE WERE TOLD TO CLB AND MAINTAIN 14000 FT MSL BY WASHINGTON APCH. WE HEARD THAT ACR Y AIRLINES MJ-80 WAS CLRED TO 12000 FT. IT APPEARED THAT APCH WAS HAVING A HARD TIME COMMUNICATING WITH THE ACR Y JET. WE COULD HEAR THE AGITATION IN THE CTLR'S VOICE. HE THEN CAME BACK AND ASKED US WHAT ALT WE WERE AT. WE TOLD HIM WE WERE CLBING THROUGH 12800 FT. HE TOLD US TO DSND BACK DOWN TO 12000 FT. DURING THE DSCNT, THE TCASII WARNED US OF TFC. I LOOKED DOWN AND SAW THAT WE WERE DSNDING ON TOP OF AN ACR Y JET. WE ONCE AGAIN CALLED APCH ON 126.55 AND TOLD HIM TO VERIFY OUR ASSIGNED ALT. HE THEN TOLD US WE WERE SUPPOSED TO BE AT 14000 FT. WE CLBED BACK UP TO 14000 AND THE CTLR FINALLY VECTORED US BACK TO THE AMI 091 DEG RADIAL. THE TCASII DID NOT HAVE US RESPOND TO THE CONFLICT. I BELIEVE IF THE ACR Y JET WOULD HAVE COMMUNICATED BETTER, THIS WOULD HAVE BEEN AVOIDED. ALSO, THERE WAS A LOT OF RADIO CONGESTION.
