Narrative:
On climb out ATC called traffic. I acquired it visually and told first officer to ask for a turn behind descending (shorts 300?) aircraft. ATC said no. Maintain 15000 ft...(we were cleared to 17000 ft). I said no, we are continuing the climb as to stop it would have made it much closer. We missed -- no problem except the TCASII was going crazy and it would have been a lot easier to turn behind the aircraft. I don't know if switch went off.

Title: ACR X NON ADHERENCE TO ATC CLRNC CLB THROUGH ASSIGNED ALT HAD LTSS FROM ACR Y.
Narrative: ON CLBOUT ATC CALLED TFC. I ACQUIRED IT VISUALLY AND TOLD FO TO ASK FOR A TURN BEHIND DSNDING (SHORTS 300?) ACFT. ATC SAID NO. MAINTAIN 15000 FT...(WE WERE CLRED TO 17000 FT). I SAID NO, WE ARE CONTINUING THE CLB AS TO STOP IT WOULD HAVE MADE IT MUCH CLOSER. WE MISSED -- NO PROB EXCEPT THE TCASII WAS GOING CRAZY AND IT WOULD HAVE BEEN A LOT EASIER TO TURN BEHIND THE ACFT. I DON'T KNOW IF SWITCH WENT OFF.
