Narrative:

We were on the drake 6 SID out of phoenix, climbing to FL240, on the pxr 336 degree radial toward banyo intersection. ZAB cleared us direct to hector VOR, so we were in a left climbing turn. Passing through approximately 12400 ft, we received a TA: a target at our 10 O'clock position, converging rapidly, 1000 ft above. TCASII resolution announced 'stop vertical climb,' then almost immediately announced, 'descend, descend.' we initiated a descent at approximately 12900 ft, and the target passed directly overhead (according to the TCASII display, because we were IMC the entire time) at a 90 degree angle, 400 ft vertical separation. I do not believe the traffic could have been maintaining VFR conditions, with proper cloud clearance at 13500 ft nebound. We immediately notified abq that we were reacting to a TCASII resolution , and asked for information on the target aircraft. ZAB gave us their phone number and when we got to burbank, ca, we called the supervisor. He advised us that radar showed a converging VFR target, squawking 1200, nebound at 13500 ft. The controller failed to see the conflict, and for that, he apologized. He felt real upset about it. We accepted the apology, and asked the supervisor if they could find out the destination of the target aircraft. We plan to notify our air safety committee and our ATC company coordinator.

TCASII RESOLUTION ANNOUNCED 'STOP VERT CLB,' THEN ALMOST IMMEDIATELY ANNOUNCED, 'DSND, DSND.' WE INITIATED A DSCNT AT APPROX 12900 FT, AND THE TARGET PASSED DIRECTLY OVERHEAD (ACCORDING TO THE TCASII DISPLAY, BECAUSE WE WERE IMC THE ENTIRE TIME) AT A 90 DEG ANGLE, 400 FT VERT SEPARATION. I DO NOT BELIEVE THE TFC COULD HAVE BEEN MAINTAINING VFR CONDITIONS, WITH PROPER CLOUD CLRNC AT 13500 FT NEBOUND. WE ACCEPTED THE APOLOGY, AND ASKED THE SUPVR IF THEY COULD FIND OUT THE DEST OF THE TARGET ACFT. WE PLAN TO NOTIFY OUR AIR SAFETY COMMITTEE AND OUR ATC COMPANY COORDINATOR.
