Narrative:
Our flight was going from day to roc with a stop in pit. During the walk around with my ice stick, I noticed no falling precipitation, but moisture in the air was freezing on the wings on their inner areas that contained fuel. Leaving the gate we taxied to the 'wash rack' for deicing. The ATIS at the time did not call for freezing rain or drizzle. We were deiced with hot type 1 and received our deice notification and left the 'car wash.' we were airborne within 5 mins. We did not pick up the new ATIS, indeed did not know that a new one was up and now calling freezing rain. Now, the FAA says we took off without being deiced with type ii fluid. From the deice report to takeoff I made 4 frequency changes and 2 checklists. I don't go for an ATIS (new) unless warned. It might be wise for the deice crew to monitor the ATIS for changes. We saw no freezing rain. We really rely on the company to apply the correct fluid. But now the FAA says it's our fault.

Title: WRONG DEICING FLUID FOR THE RPTED CONDITIONS.
Narrative: OUR FLT WAS GOING FROM DAY TO ROC WITH A STOP IN PIT. FROM THE DEICE RPT TO TKOF I MADE 4 FREQ CHANGES AND 2 CHKLISTS. I DON'T GO FOR AN ATIS (NEW) UNLESS WARNED. IT MIGHT BE WISE FOR THE DEICE CREW TO MONITOR THE ATIS FOR CHANGES. WE SAW NO FREEZING RAIN. WE REALLY RELY ON THE COMPANY TO APPLY THE CORRECT FLUID. BUT NOW THE FAA SAYS IT'S OUR FAULT.
