Narrative:
Call sign of air carrier X controller kept calling us Y or Z -- this was done repeatedly and each time we not just corrected him but made sure we were aknowledging for and/or with the correct call sign. He, the controller said it was a long, difficult day and almost by indication only admitted that he was beat and tired. The flight crew also acknowledged this saying that we were at the end of a trip and were also ready to go home. During this interim time and at the same time included in the instruction (with wrong call sign) a crossing restr of 16000 ft at ATR. Descent was initiated. Subsequent transmission between the controller and the crew (again with wrong call sign) distraction us and we missed the crossing restr. Upon frequency change we were asked about the restr and acknowledged that we were not going to make it. Controller said no problem and not to worry about it.

Title: ACR X ALTDEV. NON ADHERENCE TO ATC CLRNC, FAILED TO MEET ALT XING RESTR.
Narrative: CALL SIGN OF ACR X CTLR KEPT CALLING US Y OR Z -- THIS WAS DONE REPEATEDLY AND EACH TIME WE NOT JUST CORRECTED HIM BUT MADE SURE WE WERE AKNOWLEDGING FOR AND/OR WITH THE CORRECT CALL SIGN. HE, THE CTLR SAID IT WAS A LONG, DIFFICULT DAY AND ALMOST BY INDICATION ONLY ADMITTED THAT HE WAS BEAT AND TIRED. THE FLC ALSO ACKNOWLEDGED THIS SAYING THAT WE WERE AT THE END OF A TRIP AND WERE ALSO READY TO GO HOME. DURING THIS INTERIM TIME AND AT THE SAME TIME INCLUDED IN THE INSTRUCTION (WITH WRONG CALL SIGN) A XING RESTR OF 16000 FT AT ATR. DSCNT WAS INITIATED. SUBSEQUENT XMISSION BTWN THE CTLR AND THE CREW (AGAIN WITH WRONG CALL SIGN) DISTR US AND WE MISSED THE XING RESTR. UPON FREQ CHANGE WE WERE ASKED ABOUT THE RESTR AND ACKNOWLEDGED THAT WE WERE NOT GOING TO MAKE IT. CTLR SAID NO PROB AND NOT TO WORRY ABOUT IT.
