Narrative:
During approach vectoring approximately 15 mi west of sju on frequency 119.4, TCASII advised traffic immediately followed by RA to climb at 2000 FPM. Traffic was plus 7 at approximately 1 mi at our 11:30 position. Next RA was descend at 2000 FPM. While passing through 2700 ft, separation indicated plus 5. Complete occurrence took place in thick clouds with bases at about 220 ft. Debrief with supervisor sju approach control indicated the situation was a somewhat common occurrence. I rate it as a situation that may develop into an accident if procedures and requirements are continued as they presently exist. Callback conversation with reporter revealed the following information: reporter stated he was the captain, not flying. TA was received prior to RA. Controller had not issued traffic and flight crew did not inquire about traffic. First officer refused to follow RA because it would have climbed the aircraft into the traffic. TRACON supervisor did not state whether the traffic was IFR or VFR and the reporter did not ask. Reporter stated flight crew did not inform controller about RA until on the ground during flight crew ATC review.

Narrative: DURING APCH VECTORING APPROX 15 MI W OF SJU ON FREQ 119.4, TCASII ADVISED TFC IMMEDIATELY FOLLOWED BY RA TO CLB AT 2000 FPM. TFC WAS PLUS 7 AT APPROX 1 MI AT OUR 11:30 POS. NEXT RA WAS DSND AT 2000 FPM. WHILE PASSING THROUGH 2700 FT, SEPARATION INDICATED PLUS 5. COMPLETE OCCURRENCE TOOK PLACE IN THICK CLOUDS WITH BASES AT ABOUT 220 FT. DEBRIEF WITH SUPVR SJU APCH CTL INDICATED THE SIT WAS A SOMEWHAT COMMON OCCURRENCE. I RATE IT AS A SIT THAT MAY DEVELOP INTO AN ACCIDENT IF PROCS AND REQUIREMENTS ARE CONTINUED AS THEY PRESENTLY EXIST. CALLBACK CONVERSATION WITH RPTR REVEALED THE FOLLOWING INFO: RPTR STATED HE WAS THE CAPT, NOT FLYING. TA WAS RECEIVED PRIOR TO RA. CTLR HAD NOT ISSUED TFC AND FLC DID NOT INQUIRE ABOUT TFC. FO REFUSED TO FOLLOW RA BECAUSE IT WOULD HAVE CLBED THE ACFT INTO THE TFC. TRACON SUPVR DID NOT STATE WHETHER THE TFC WAS IFR OR VFR AND THE RPTR DID NOT ASK. RPTR STATED FLC DID NOT INFORM CTLR ABOUT RA UNTIL ON THE GND DURING FLC ATC REVIEW.
