Narrative:

On climbing out we were on a radar vector at 4000 ft and a 220 degree heading on the newark 4 departure, about 10 mi west of the airport. The controller asked if we had traffic (a cessna 210) in sight, 11 O'clock, 5 mi, I believe. I found the traffic and said 'traffic in sight.' the controller said to climb to 6000 ft reference the traffic. The first officer started a climb and as the cessna approached I asked the first officer to be sure if he had the traffic. I took the nod as having the cessna in sight. The TCASII was giving its warning. The first officer was ignoring the warning to descend. I saw the cessna bank right and the conflict was over. To do over again, I would be more assertive to start a right turn earlier.

Title: FLC OF A WDB OBSERVED ANOTHER ACFT TAKE EVASIVE ACTION DURING CLBOUT BY AN ACFT GIVEN AS A TA FROM ATC.

Narrative: ON CLBING OUT WE WERE ON A RADAR VECTOR AT 4000 FT AND A 220 DEG HDG ON THE NEWARK 4 DEP, ABOUT 10 MI W OF THE ARPT. THE CTLR ASKED IF WE HAD TFC (A CESSNA 210) IN SIGHT, 11 O'CLOCK, 5 MI, I BELIEVE. I FOUND THE TFC AND SAID 'TFC IN SIGHT.' THE CTLR SAID TO CLB TO 6000 FT REF THE TFC. THE FO STARTED A CLB AND AS THE CESSNA APCHED I ASKED THE FO TO BE SURE IF HE HAD THE TFC. I TOOK THE NOD AS HAVING THE CESSNA IN SIGHT. THE TCASII WAS GIVING ITS WARNING. THE FO WAS IGNORING THE WARNING TO DSND. I SAW THE CESSNA BANK RIGHT AND THE CONFLICT WAS OVER. TO DO OVER AGAIN, I WOULD BE MORE ASSERTIVE TO START A R TURN EARLIER.
