Narrative:
Aircraft being flown by captain, we leveled off at 10000 ft and switched to ZNY, 133.67 for higher. TCASII subject appeared on screen at 12 O'clock exactly same altitude. TA then transformed into an RA 'climb, climb, climb.' could not make visual contact. Captain disconnected autoplt and followed RA as per procedure, doing a perfect example. ATC was advised by first officer that we left our assigned altitude due to TCASII RA. ATC was very unconcerned, never called traffic and then said it was a 10500 ft VFR cruise, which it was not. ATC then cleared us to 14000 ft, as if nothing happened. Without TCASII, the writer (first officer) believes this would have been a most probable collision.

Title: EVASIVE ACTION CLB. ACR REACTS TO A TCASII RA, BUT DOES NOT SEE THE INTRUDER. THE CTLR RPTED THAT A VFR ACFT WAS IN THE AREA, BUT THE FLC DOUBTS THAT IT WAS THE CORRECT ACFT.
Narrative: ACFT BEING FLOWN BY CAPT, WE LEVELED OFF AT 10000 FT AND SWITCHED TO ZNY, 133.67 FOR HIGHER. TCASII SUBJECT APPEARED ON SCREEN AT 12 O'CLOCK EXACTLY SAME ALT. TA THEN TRANSFORMED INTO AN RA 'CLB, CLB, CLB.' COULD NOT MAKE VISUAL CONTACT. CAPT DISCONNECTED AUTOPLT AND FOLLOWED RA AS PER PROC, DOING A PERFECT EXAMPLE. ATC WAS ADVISED BY FO THAT WE LEFT OUR ASSIGNED ALT DUE TO TCASII RA. ATC WAS VERY UNCONCERNED, NEVER CALLED TFC AND THEN SAID IT WAS A 10500 FT VFR CRUISE, WHICH IT WAS NOT. ATC THEN CLRED US TO 14000 FT, AS IF NOTHING HAPPENED. WITHOUT TCASII, THE WRITER (FO) BELIEVES THIS WOULD HAVE BEEN A MOST PROBABLE COLLISION.
