Narrative:
On jul/mon/95 at XA30 on the northeast side of maui descending out of haleakala crater for the shoreline, my route of flight went from the haleakala crater to kipahulu, and, upon reaching the homes of kipahulu, I estimated that the WX was possible to pass above homes and stay within sfar clrncs. Upon reaching cloud layer, I realized that I had to discontinue my tour flight due to low cloud layer and proceeded offshore at 1500 ft MSL. Thus far possibly going below the low cloud clearance of the sfar for about 30- 50 seconds. As the WX improved around the hana coast, I resumed sfar minimums and returned back to kahului international airport. Note: in no way have I imposed danger on the lives of people or passenger but I'm writing this form to advise you of the situation. Solution: there must be some leeway from the sfar in an area where there's a decision to fly to get out of the area to exit some unexpected situation without a pilot being ticketed by the FAA.

Title: AN AIR TOUR HELI HAD A PROB COMPLYING WITH SFAR 71 WHILE FLYING NEAR OGG.
Narrative: ON JUL/MON/95 AT XA30 ON THE NE SIDE OF MAUI DSNDING OUT OF HALEAKALA CRATER FOR THE SHORELINE, MY RTE OF FLT WENT FROM THE HALEAKALA CRATER TO KIPAHULU, AND, UPON REACHING THE HOMES OF KIPAHULU, I ESTIMATED THAT THE WX WAS POSSIBLE TO PASS ABOVE HOMES AND STAY WITHIN SFAR CLRNCS. UPON REACHING CLOUD LAYER, I REALIZED THAT I HAD TO DISCONTINUE MY TOUR FLT DUE TO LOW CLOUD LAYER AND PROCEEDED OFFSHORE AT 1500 FT MSL. THUS FAR POSSIBLY GOING BELOW THE LOW CLOUD CLRNC OF THE SFAR FOR ABOUT 30- 50 SECONDS. AS THE WX IMPROVED AROUND THE HANA COAST, I RESUMED SFAR MINIMUMS AND RETURNED BACK TO KAHULUI INTL ARPT. NOTE: IN NO WAY HAVE I IMPOSED DANGER ON THE LIVES OF PEOPLE OR PAX BUT I'M WRITING THIS FORM TO ADVISE YOU OF THE SIT. SOLUTION: THERE MUST BE SOME LEEWAY FROM THE SFAR IN AN AREA WHERE THERE'S A DECISION TO FLY TO GET OUT OF THE AREA TO EXIT SOME UNEXPECTED SIT WITHOUT A PLT BEING TICKETED BY THE FAA.
