Narrative:
We departed cvg on the assigned 105 degree radial enroute to york VOR. We were cleared to FL220. As we climbed through 11500 ft we got a TCASII alert to an aircraft 1000 ft above at 5 mi. I slowed my climb looking for a target. We entered the base of cloud deck so I made a turn to the right to avoid a possible collision course. My first officer called indy center to ask about the traffic. They sheepishly admitted to there being VFR traffic now behind us at 12500 ft, but it was in contact with approach control possibly. He said that if the traffic were with approach they would try to contact him. The aircraft in question was illegally flying IFR although on a VFR flight plan. Since indy center was not controling him I guess they felt they need not tell us about the traffic?! We were thankful for the TCASII alert!!

Title: MLG CLBING RECEIVES TCASII RA.

THE ACFT IN QUESTION WAS ILLEGALLY FLYING IFR ALTHOUGH ON A VFR FLT PLAN. SINCE INDY CTR WAS NOT CTLING HIM I GUESS THEY FELT THEY NEED NOT TELL US ABOUT THE TFC?! WE WERE THANKFUL FOR THE TCASII ALERT!!
