Narrative:
Cleared to climb from 11000 ft to cluts intersection. Center asked if we had C130 in sight at 12000 ft. When we replied that we did, center cleared us to FL360. It appeared the C130 was crossing our course at about a 30 degree angle from our 2 O'clock position. We began a climb and TCASII said increase climb, then a few seconds later, changed its command and said decrease climb, descend. By that time, we saw the C130 closer, it was apparent he was crossing our course at 90 degrees. We had to make a rather brisk level off and descent to comply with TCASII. There was a rapid closure rate with the traffic. The TCASII brought us under the C130 as he passed. I feel clearing us through the C130's altitude at that distance was a mistake. We were indicating 350 KTS and our closure rate was rapid at this speed. At the distance we saw the C130 it was difficult to pick up his direction of flight.

Title: ACR DC10 HAS NMAC WITH MIL ACFT WHILE IN CLB.
Narrative: CLRED TO CLB FROM 11000 FT TO CLUTS INTXN. CTR ASKED IF WE HAD C130 IN SIGHT AT 12000 FT. WHEN WE REPLIED THAT WE DID, CTR CLRED US TO FL360. IT APPEARED THE C130 WAS XING OUR COURSE AT ABOUT A 30 DEG ANGLE FROM OUR 2 O'CLOCK POS. WE BEGAN A CLB AND TCASII SAID INCREASE CLB, THEN A FEW SECONDS LATER, CHANGED ITS COMMAND AND SAID DECREASE CLB, DSND. BY THAT TIME, WE SAW THE C130 CLOSER, IT WAS APPARENT HE WAS XING OUR COURSE AT 90 DEGS. WE HAD TO MAKE A RATHER BRISK LEVEL OFF AND DSCNT TO COMPLY WITH TCASII. THERE WAS A RAPID CLOSURE RATE WITH THE TFC. THE TCASII BROUGHT US UNDER THE C130 AS HE PASSED. I FEEL CLRING US THROUGH THE C130'S ALT AT THAT DISTANCE WAS A MISTAKE. WE WERE INDICATING 350 KTS AND OUR CLOSURE RATE WAS RAPID AT THIS SPD. AT THE DISTANCE WE SAW THE C130 IT WAS DIFFICULT TO PICK UP HIS DIRECTION OF FLT.
