Narrative:

Departing sjc on dec/xx/95, we were issued the loupe 9 departure on our flight to pdx. We completed the departure fine, except for the fact that as we were turned back to the sjc VOR we were issued a clearance to cross the VOR at 12000 ft climb and maintain FL230. I queried the PNF to the climb instructions, and he thought we were given an unrestr climb to FL230. Although there were no traffic conflicts I crossed the sjc VOR at 14000 ft, when the controller came on at this point and issued a unrestrictive climb to FL230. The PNF misunderstanding of the original climb clearance, caused us as a crew to violate a crossing restr at the sjc VOR at 12000 ft.

Narrative: DEPARTING SJC ON DEC/XX/95, WE WERE ISSUED THE LOUPE 9 DEP ON OUR FLT TO PDX. I QUERIED THE PNF TO THE CLB INSTRUCTIONS, AND HE THOUGHT WE WERE GIVEN AN UNRESTR CLB TO FL230. ALTHOUGH THERE WERE NO TFC CONFLICTS I CROSSED THE SJC VOR AT 14000 FT, WHEN THE CTLR CAME ON AT THIS POINT AND ISSUED A UNRESTRICTIVE CLB TO FL230. THE PNF MISUNDERSTANDING OF THE ORIGINAL CLB CLRNC, CAUSED US AS A CREW TO VIOLATE A XING RESTR AT THE SJC VOR AT 12000 FT.
