Airport noise abatement procedure requires certain types of aircraft to reduce speed after takeoff. Controller released an MD88 behind a B727 with standard separation, however, the first aircraft reduced speed to comply with the noise procedure causing the second aircraft to overtake the first aircraft. The controller vectored both aircraft to avoid a conflict.

Narrative:

Palm beach county noise abatement officials have forced carriers flying stage ii aircraft to use reduced power settings on departure or be fined. ATC doesn't know when these B727's are going to implement these procedures. Aircraft X departed pbi. Aircraft Y departed behind aircraft X with standard separation. Aircraft X had to be turned left and aircraft Y had to be turned right to avoid a midair. This scenario has occurred more than a dozen times in the past 60 days. Aircraft X stated he was following company policy.
