Narrative:
After departure from montego bay-sangster airport as flight X, mkjk issued a clearance to cross pvtul intersection at FL310. During the climb the captain (PF) mentioned again the crossing restr. Subsequently kingston issued a clearance to climb to FL350, without restating a restr at pvtul. While still in contact with kingston, I called havana center to establish radio contact prior to the fir with our initial clearance altitude of FL310. I later called havana with the new altitude of FL350. At pvtul, kingston called us saying we were to cross at FL310, and our altitude was FL290 in a climb. We had neglected to tell kingston that our climb was not going to enable us to cross pvtul at FL310, but since the clearance to FL350 didn't restate the FL310 restr at pvtul, we should not have been restr. Perhaps the caribbean rules are different on this issue. However, a safer practice would be to ask if the restr still applies. We erred twice on this matter.

Title: FLC OF AN LGT FAILED TO MEET XING RESTR CLB ALT DURING CLB TO CRUISE ALT DUE TO A MISUNDERSTANDING OF A SUBSEQUENT CLRNC TO A HIGHER ALT.
Narrative: AFTER DEP FROM MONTEGO BAY-SANGSTER ARPT AS FLT X, MKJK ISSUED A CLRNC TO CROSS PVTUL INTXN AT FL310. DURING THE CLB THE CAPT (PF) MENTIONED AGAIN THE XING RESTR. SUBSEQUENTLY KINGSTON ISSUED A CLRNC TO CLB TO FL350, WITHOUT RESTATING A RESTR AT PVTUL. WHILE STILL IN CONTACT WITH KINGSTON, I CALLED HAVANA CTR TO ESTABLISH RADIO CONTACT PRIOR TO THE FIR WITH OUR INITIAL CLRNC ALT OF FL310. I LATER CALLED HAVANA WITH THE NEW ALT OF FL350. AT PVTUL, KINGSTON CALLED US SAYING WE WERE TO CROSS AT FL310, AND OUR ALT WAS FL290 IN A CLB. WE HAD NEGLECTED TO TELL KINGSTON THAT OUR CLB WAS NOT GOING TO ENABLE US TO CROSS PVTUL AT FL310, BUT SINCE THE CLRNC TO FL350 DIDN'T RESTATE THE FL310 RESTR AT PVTUL, WE SHOULD NOT HAVE BEEN RESTR. PERHAPS THE CARIBBEAN RULES ARE DIFFERENT ON THIS ISSUE. HOWEVER, A SAFER PRACTICE WOULD BE TO ASK IF THE RESTR STILL APPLIES. WE ERRED TWICE ON THIS MATTER.
