Narrative:
We were restr to 10000 ft MSL due to the passenger oxygen being inoperative. The flight plan was the normal route except for the 10000 ft restr, which is usually 16000 ft (printed on the dispatch). The clearance was the same except for the fact the controller gave us 16000 ft as final instead of 10000 ft for the oxygen being inoperative. I, by mistake, read back 16000 ft instead of 10000 ft. We then took off and the controller gave us 5000 ft to 10000 ft. I then informed the controller we were restr to 10000 ft because of the oxygen. At this time the controllers became irate, saying how much trouble we were causing them, resulting in rerouting. New york departure then put us on a different route because of the lower altitude. They also asked us why we accepted the high route from clearance. My response was, 'it was my mistake and forgot about the MEL.' next time I will be more aware of any restrs on the clearance and MEL items.
Original NASA ASRS Text
Title: FLT RESTR TO 10000 FT BECAUSE OF PAX OXYGEN INOP. WHEN FLC READ BACK CLRNC TO 16000 FT THEY FORGOT THE RESTR UNTIL AFTER TKOF. ATC WAS UPSET WITH FLC FOR ACCEPTING CLRNC.
Narrative: WE WERE RESTR TO 10000 FT MSL DUE TO THE PAX OXYGEN BEING INOP. THE FLT PLAN WAS THE NORMAL RTE EXCEPT FOR THE 10000 FT RESTR, WHICH IS USUALLY 16000 FT (PRINTED ON THE DISPATCH). THE CLRNC WAS THE SAME EXCEPT FOR THE FACT THE CTLR GAVE US 16000 FT AS FINAL INSTEAD OF 10000 FT FOR THE OXYGEN BEING INOP. I, BY MISTAKE, READ BACK 16000 FT INSTEAD OF 10000 FT. WE THEN TOOK OFF AND THE CTLR GAVE US 5000 FT TO 10000 FT. I THEN INFORMED THE CTLR WE WERE RESTR TO 10000 FT BECAUSE OF THE OXYGEN. AT THIS TIME THE CTLRS BECAME IRATE, SAYING HOW MUCH TROUBLE WE WERE CAUSING THEM, RESULTING IN REROUTING. NEW YORK DEP THEN PUT US ON A DIFFERENT RTE BECAUSE OF THE LOWER ALT. THEY ALSO ASKED US WHY WE ACCEPTED THE HIGH RTE FROM CLRNC. MY RESPONSE WAS, 'IT WAS MY MISTAKE AND FORGOT ABOUT THE MEL.' NEXT TIME I WILL BE MORE AWARE OF ANY RESTRS ON THE CLRNC AND MEL ITEMS.
