Narrative:
We leveled off at 10000 ft MSL and were trying to work out a pressurization and air conditioning problem. Alb approach pointed out a traffic target, unverified, to our left and climbing. At the time we were IMC, but were looking. Alb approach gave us a heading change to the left and we requested a change to the right to avoid a large buildup. Shortly after alb approach issued a TA to us and gave us a heading change and told us the traffic was at our 11 O'clock and climbing. At that time we briefly popped out of IMC into VMC and spotted the aircraft nearby. I immediately initiated a climbing turn to the right to avoid the traffic. Once we were clear we returned to our original altitude. Our TCASII system was inoperative'ed earlier that day!

Title: A COMMUTER FLC TOOK EVASIVE ACTION TO AVOID AN ACFT AFTER ENTERING VMC FROM IMC. THE CREW HAD BEEN DEVIATING AROUND WX AND WAS ALERTED BY THE APCH CTLR WHO ALSO ISSUED A HDG CHANGE.

AT THE TIME WE WERE IMC, BUT WERE LOOKING. ALB APCH GAVE US A HDG CHANGE TO THE L AND WE REQUESTED A CHANGE TO THE R TO AVOID A LARGE BUILDUP. SHORTLY AFTER ALB APCH ISSUED A TA TO US AND GAVE US A HDG CHANGE AND TOLD US THE TFC WAS AT OUR 11 O'CLOCK AND CLBING. AT THAT TIME WE BRIEFLY POPPED OUT OF IMC INTO VMC AND SPOTTED THE ACFT NEARBY. I IMMEDIATELY INITIATED A CLBING TURN TO THE R TO AVOID THE TFC. ONCE WE WERE CLR WE RETURNED TO OUR ORIGINAL ALT. OUR TCASII SYS WAS INOP'ED EARLIER THAT DAY!
