Narrative:

WX delay of 1+ hours for departure. Thunderstorms in vicinity. Captain flew assigned heading after departure. I called departure control and did after takeoff checklist. We then received a left turn to 360 degrees and climb to 17000 ft. As we passed 9400 ft (I had just looked at the altimeter) we had a call from departure 'traffic 12 O'clock, 9000 ft.' I looked out and down, saw a regional jet close enough to read the logo. We do not have TCASII. I'm petitioning the chief pilot for it as soon as I submit this report. I know approach and departure have a difficult time with WX, heavy traffic, etc, but this one scares me. I was under the impression (obviously in error). The terminal radar computers would not allow this. How about the controller's judgement in this scenario? Was the other aircraft late in a descent? Does he have TCASII? Again, 400 ft and less than 1/2 mi is too close for comfort.

I WAS UNDER THE IMPRESSION (OBVIOUSLY IN ERROR). THE TERMINAL RADAR COMPUTERS WOULD NOT ALLOW THIS. HOW ABOUT THE CTLR'S JUDGEMENT IN THIS SCENARIO? WAS THE OTHER ACFT LATE IN A DSCNT? DOES HE HAVE TCASII? AGAIN, 400 FT AND LESS THAN 1/2 MI IS TOO CLOSE FOR COMFORT.
