Narrative:
During climb out to conduct high work for annual check ride. Student at controls, noticed T34B appear from beneath our aircraft and directly ahead. Student announced 'traffic' and conducted immediate left climbing turn to avoid collision. Notified ATC of near miss. Contacted ATC upon completion of flight. Supervisor advised us that traffic was in fact a T34B with a 'dog fighting' school. Aircraft was possibly performing acrobatics during near miss. Student did an excellent job of maintaining a VFR scan. Our aircraft are currently being modified to add a GPS/FMS and TCASII. No TCASII was installed in this aircraft. Heads up scan saved our lives! Closest miss I've had in 15+ yrs of flying.

Title: A MIL DC9 FLC AVOIDS A CLBING MANEUVERING T34 AT THEIR ALT, RIGHT IN FRONT OF THEM. ACFT Y ASSUMED TO BE FROM A LCL 'TOP GUN' SCHOOL.
Narrative: DURING CLBOUT TO CONDUCT HIGH WORK FOR ANNUAL CHK RIDE. STUDENT AT CTLS, NOTICED T34B APPEAR FROM BENEATH OUR ACFT AND DIRECTLY AHEAD. STUDENT ANNOUNCED 'TFC' AND CONDUCTED IMMEDIATE L CLBING TURN TO AVOID COLLISION. NOTIFIED ATC OF NEAR MISS. CONTACTED ATC UPON COMPLETION OF FLT. SUPVR ADVISED US THAT TFC WAS IN FACT A T34B WITH A 'DOG FIGHTING' SCHOOL. ACFT WAS POSSIBLY PERFORMING ACROBATICS DURING NEAR MISS. STUDENT DID AN EXCELLENT JOB OF MAINTAINING A VFR SCAN.
