Narrative:
First officer was PF. Captain was PNF. Assigned and departed teb on dalton departure runway 19. After takeoff, 800 ft, turned right to 280 degrees, leveled at 1300 ft. Switched frequency to new york departure 128.55. Controller said 'climb and maintain 11000 ft, turn right heading XXX degrees.' PNF: 'climb 11000 ft, say again heading.' controller: 'climb and maintain 11000 ft, turn right heading 280 degrees.' PNF: 'climb 11000 ft, right 280 degrees.' proceeded to initiate climb and increase speed. At approximately 2200 ft, B727 on approach to ewr, in descent, crossed our flight path too close for comfort. Controller: 'what are you doing? I told you to maintain 1300 ft.' PNF: 'sir, you told us to climb to 11000 ft. I read 11000 ft back to you, clearly, 2 times.' PNF: 'so you want us to descend to 1300 ft?' controller: no, you may as well climb now. Climb and maintain 10000 ft.' PNF: 'climb 10000 ft.' corrective action was slight due to situation. A momentary leveloff to ensure we would not climb into the B727.
Original NASA ASRS Text
Title: A LEAR 35A AIR TAXI ON THE DALTON DEP OUT OF TEB HAS A POTENTIAL CONFLICT WITH A B727 FREIGHTER ON APCH TO EWR ARPT.
Narrative: FO WAS PF. CAPT WAS PNF. ASSIGNED AND DEPARTED TEB ON DALTON DEP RWY 19. AFTER TKOF, 800 FT, TURNED R TO 280 DEGS, LEVELED AT 1300 FT. SWITCHED FREQ TO NEW YORK DEP 128.55. CTLR SAID 'CLB AND MAINTAIN 11000 FT, TURN R HDG XXX DEGS.' PNF: 'CLB 11000 FT, SAY AGAIN HDG.' CTLR: 'CLB AND MAINTAIN 11000 FT, TURN R HDG 280 DEGS.' PNF: 'CLB 11000 FT, R 280 DEGS.' PROCEEDED TO INITIATE CLB AND INCREASE SPD. AT APPROX 2200 FT, B727 ON APCH TO EWR, IN DSCNT, CROSSED OUR FLT PATH TOO CLOSE FOR COMFORT. CTLR: 'WHAT ARE YOU DOING? I TOLD YOU TO MAINTAIN 1300 FT.' PNF: 'SIR, YOU TOLD US TO CLB TO 11000 FT. I READ 11000 FT BACK TO YOU, CLRLY, 2 TIMES.' PNF: 'SO YOU WANT US TO DSND TO 1300 FT?' CTLR: NO, YOU MAY AS WELL CLB NOW. CLB AND MAINTAIN 10000 FT.' PNF: 'CLB 10000 FT.' CORRECTIVE ACTION WAS SLIGHT DUE TO SIT. A MOMENTARY LEVELOFF TO ENSURE WE WOULD NOT CLB INTO THE B727.
