Narrative:

Flight from sju-jfk, ATC kept us at FL280 due to conflicting traffic. This caused approximately 2000 pounds over-burn. Next WX at jfk was low IFR when forecast was marginal VFR. Alternate was ewr which was also low IFR. When we were given a hold for jfk, we immediately informed ATC of the need to now go to ewr. After one turn in hold we were then vectored away from ewr. I told the controller I would have to declare an emergency if needed to get to an airport if needed as only 1 hour fuel remained. Jfk traffic and WX improved, so the controller then handled us normally and we landed at jfk with 45 mins fuel remaining. In the future I will use a more distant alternate if 'either' current or forecast WX is low IFR.

Title: CAPT OF AN LGT ADVISED APCH CTLR OF MINIMUM FUEL DUE TO WX DELAY AND HIGHER FUEL BURN THAN FLT PLANNED AND THAT HE WOULD HAVE TO DECLARE AN EMER IF THERE WERE ANY MORE DELAYS. CTLR WAS ABLE TO WORK HIM INTO THE TFC FLOW WITHOUT FURTHER DELAY WITHOUT USING EMER PROCS.

Narrative: FLT FROM SJU-JFK, ATC KEPT US AT FL280 DUE TO CONFLICTING TFC. THIS CAUSED APPROX 2000 LBS OVER-BURN. NEXT WX AT JFK WAS LOW IFR WHEN FORECAST WAS MARGINAL VFR. ALTERNATE WAS EWR WHICH WAS ALSO LOW IFR. WHEN WE WERE GIVEN A HOLD FOR JFK, WE IMMEDIATELY INFORMED ATC OF THE NEED TO NOW GO TO EWR. AFTER ONE TURN IN HOLD WE WERE THEN VECTORED AWAY FROM EWR. I TOLD THE CTLR I WOULD HAVE TO DECLARE AN EMER IF NEEDED TO GET TO AN ARPT IF NEEDED AS ONLY 1 HR FUEL REMAINED. JFK TFC AND WX IMPROVED, SO THE CTLR THEN HANDLED US NORMALLY AND WE LANDED AT JFK WITH 45 MINS FUEL REMAINING. IN THE FUTURE I WILL USE A MORE DISTANT ALTERNATE IF 'EITHER' CURRENT OR FORECAST WX IS LOW IFR.
