Narrative:
Departed sjc on loupe 9 departure. After reaching 5000 ft and heading 120 degrees, ATC clearing flight to climb unrestr to 15000 ft. Captain was flying and asked first officer to clarify that we did not have the 12000 ft restr over the sjc VOR as published. ATC confirmed no restr over VOR. Having flown this departure SID approximately 20-30 times (but only 1 time in approximately 6 months -- no excuses), I was conditioned to receiving clearance to climb and turn on course at the same time. I proceeded to turn right when I felt capable of still making the 12000 ft restr over the VOR, only to be advised to turn back to a heading of 130 degrees after about 30-40 degrees of right turn. No clearance to turn on course given by ATC. I heard what I wanted and expected to hear. Need to pay closer attention to ATC clrncs and follow SID as depicted. Supplemental information from acn 473541: the first officer was talking to company on second radio. The 'off' call to operations should've waited until off the SID.

Title: MD80 CREW HAD TRACK DEV ON THE LOUPE 9 SID AT SJC.
Narrative: DEPARTED SJC ON LOUPE 9 DEP. AFTER REACHING 5000 FT AND HDG 120 DEGS, ATC CLRING FLT TO CLB UNRESTR TO 15000 FT. CAPT WAS FLYING AND ASKED FO TO CLARIFY THAT WE DID NOT HAVE THE 12000 FT RESTR OVER THE SJC VOR AS PUBLISHED. ATC CONFIRMED NO RESTR OVER VOR. HAVING FLOWN THIS DEP SID APPROX 20-30 TIMES (BUT ONLY 1 TIME IN APPROX 6 MONTHS -- NO EXCUSES), I WAS CONDITIONED TO RECEIVING CLRNC TO CLB AND TURN ON COURSE AT THE SAME TIME. I PROCEEDED TO TURN R WHEN I FELT CAPABLE OF STILL MAKING THE 12000 FT RESTR OVER THE VOR, ONLY TO BE ADVISED TO TURN BACK TO A HDG OF 130 DEGS AFTER ABOUT 30-40 DEGS OF R TURN.
