Narrative:

Just prior to scheduled departure, the #1 flight attendant informed me that the passenger in xa was still using his cell phone. She stated that in addition to the standard predep PA (advising the passenger to turn off all cell phones, computers, etc) she had instructed him 2 additional times to turn off his cell phone and that he had not complied. I left the cockpit and observed the individual still talking on his cell phone. At that time I didn't feel that any law enforcement intervention was necessary, but I did instruct the agent to remove the individual prior to closing the door. The individual was removed without incident and the flight departed.

Title: AN MD80 FLC, WHILE AT THE GATE IN TUS, WERE INFORMED BY THE #1 FLT ATTENDANT THAT A PAX, IN SPITE OF BEING TOLD REPEATEDLY TO TURN OFF HIS CELL PHONE, REFUSED TO DO SO. THE CAPT HAD HIM REMOVED FROM THE ACFT!

Narrative: JUST PRIOR TO SCHEDULED DEP, THE #1 FLT ATTENDANT INFORMED ME THAT THE PAX IN XA WAS STILL USING HIS CELL PHONE. SHE STATED THAT IN ADDITION TO THE STANDARD PREDEP PA (ADVISING THE PAX TO TURN OFF ALL CELL PHONES, COMPUTERS, ETC) SHE HAD INSTRUCTED HIM 2 ADDITIONAL TIMES TO TURN OFF HIS CELL PHONE AND THAT HE HAD NOT COMPLIED. I LEFT THE COCKPIT AND OBSERVED THE INDIVIDUAL STILL TALKING ON HIS CELL PHONE. AT THAT TIME I DIDN'T FEEL THAT ANY LAW ENFORCEMENT INTERVENTION WAS NECESSARY, BUT I DID INSTRUCT THE AGENT TO REMOVE THE INDIVIDUAL PRIOR TO CLOSING THE DOOR. THE INDIVIDUAL WAS REMOVED WITHOUT INCIDENT AND THE FLT DEPARTED.
