Narrative:
Preflight check noted aircraft on a maintenance deferral for door 1L. Initial logbook write-up was on mar/sat/02. We felt aircraft should be on a MEL status since our company manual states that any item normally MEL'ed cannot be deferred by maintenance. The initial write-up stated that the door could not be operated from the outside or inside of the aircraft with the handle in a certain position. Therefore, it should have been MEL'ed on mar/sun/02. Our company book requires it to be fixed within 10 calendar days -- now it is on its 13TH day. The maintenance supervisor came to our aircraft and placed it on MEL as of that current day, mar/fri/02. We disagreed with this, and we should not have accepted the aircraft for flight. The maintenance personnel don't have the authority/authorized to override the MEL or to arbitrarily assign an MEL date.

Narrative: PREFLT CHK NOTED ACFT ON A MAINT DEFERRAL FOR DOOR 1L. INITIAL LOGBOOK WRITE-UP WAS ON MAR/SAT/02. WE FELT ACFT SHOULD BE ON A MEL STATUS SINCE OUR COMPANY MANUAL STATES THAT ANY ITEM NORMALLY MEL'ED CANNOT BE DEFERRED BY MAINT. THE INITIAL WRITE-UP STATED THAT THE DOOR COULD NOT BE OPERATED FROM THE OUTSIDE OR INSIDE OF THE ACFT WITH THE HANDLE IN A CERTAIN POS. THEREFORE, IT SHOULD HAVE BEEN MEL'ED ON MAR/SUN/02. OUR COMPANY BOOK REQUIRES IT TO BE FIXED WITHIN 10 CALENDAR DAYS -- NOW IT IS ON ITS 13TH DAY. THE MAINT SUPVR CAME TO OUR ACFT AND PLACED IT ON MEL AS OF THAT CURRENT DAY, MAR/FRI/02.
