Narrative:
On takeoff roll from runway 4L ewr, we heard air carrier Y elect to abort his landing on runway 4R. Tower said something about trying to keep him in the traffic pattern. We did not hear him (tower) issue any missed approach instructions. At 400 ft we turned to a heading of 060 degree as per the ewr 7 departure procedure. This turned us across the departure end of runway 4R. At approximately 1000 ft we got a TCASII RA 'descend, descend.' I started a descent, copilot spotted air carrier Y first and said 'bank left.' I looked across cockpit through copilot's window and saw air carrier Y horizontally from us in what looked like a sharp right turn. We were looking at his underbelly. We both guessed separation to be from 400-500 ft. On seeing the other aircraft, I determined that we would not collide, and continued the departure. Minimal evasive action was required, as the other aircraft was in his turn. I sent message to company and followed up with call to ewr tower. We filed an near midair collision report. I think tower failed to aggressively take control of the situation that developed when air carrier Y announced his go around.
Original NASA ASRS Text
Title: NMAC BTWN A B737-800 ON TKOF RWY 4L, ON EWR 7 SID, AND A B757 ON A GAR FROM RWY 4R AT EWR.
Narrative: ON TKOF ROLL FROM RWY 4L EWR, WE HEARD ACR Y ELECT TO ABORT HIS LNDG ON RWY 4R. TWR SAID SOMETHING ABOUT TRYING TO KEEP HIM IN THE TFC PATTERN. WE DID NOT HEAR HIM (TWR) ISSUE ANY MISSED APCH INSTRUCTIONS. AT 400 FT WE TURNED TO A HDG OF 060 DEG AS PER THE EWR 7 DEP PROC. THIS TURNED US ACROSS THE DEP END OF RWY 4R. AT APPROX 1000 FT WE GOT A TCASII RA 'DSND, DSND.' I STARTED A DSCNT, COPLT SPOTTED ACR Y FIRST AND SAID 'BANK L.' I LOOKED ACROSS COCKPIT THROUGH COPLT'S WINDOW AND SAW ACR Y HORIZLY FROM US IN WHAT LOOKED LIKE A SHARP R TURN. WE WERE LOOKING AT HIS UNDERBELLY. WE BOTH GUESSED SEPARATION TO BE FROM 400-500 FT. ON SEEING THE OTHER ACFT, I DETERMINED THAT WE WOULD NOT COLLIDE, AND CONTINUED THE DEP. MINIMAL EVASIVE ACTION WAS REQUIRED, AS THE OTHER ACFT WAS IN HIS TURN. I SENT MESSAGE TO COMPANY AND FOLLOWED UP WITH CALL TO EWR TWR. WE FILED AN NMAC RPT. I THINK TWR FAILED TO AGGRESSIVELY TAKE CTL OF THE SIT THAT DEVELOPED WHEN ACR Y ANNOUNCED HIS GAR.
