Narrative:
Our aircraft position was 10 DME east of pgy VOR, direct to pgy. We were under ATC control of socal approach. Our ATC clearance was direct pgy, then pgy 270 degree radial outbound for vectors for an ILS to runway 9 at san. Our altitude was 6000 ft. ATC was controling a military aircraft, an EA6, and ATC had given him a clearance to climb to and maintain 5000 ft. We were in visual conditions with an undercast layer below us with tops at approximately 5000 ft. We observed an EA6 fighter break through the clouds at approximately our 9:30 O'clock position and climb through our altitude at a very high rate of climb within approximately 1 NM of our position. Our aircraft was on autoplt, level, approximately 240 KTS, with the seat belt sign on. As we observed the traffic passing through our altitude, ATC called traffic at 9:30 O'clock position, at 5000 ft. After the aircraft passed through our altitude, the TCASII sounded a momentary resolution alert commanding a maximum rate of descent, then immediately silenced. There was no time for an evasive maneuver or a pilot response to the TCASII alert due to the rapid climb of the EA6. The first officer immediately advised ATC of the visual on the EA6 passing through our altitude. ATC said they were aware of the traffic conflict and to call ATC after landing. After calling ATC, I was advised that the aircraft we sighted was the EA6. ATC said the tapes were pulled and an investigation was being conducted. ATC said the aircraft had been cleared to 5000 ft and that ATC would be filing a violation against the military aircraft. I was advised that the military aircraft had departed north island airport. I was advised that the preliminary findings indicated that the aircraft passed 1 mi vertically and 200 ft above us. Our aircraft proceeded to san and landed without further incident.

Narrative: OUR ACFT POS WAS 10 DME E OF PGY VOR, DIRECT TO PGY. WE WERE UNDER ATC CTL OF SOCAL APCH. ATC SAID THEY WERE AWARE OF THE TFC CONFLICT AND TO CALL ATC AFTER LNDG. AFTER CALLING ATC, I WAS ADVISED THAT THE ACFT WE SIGHTED WAS THE EA6. ATC SAID THE TAPES WERE PULLED AND AN INVESTIGATION WAS BEING CONDUCTED. ATC SAID THE ACFT HAD BEEN CLRED TO 5000 FT AND THAT ATC WOULD BE FILING A VIOLATION AGAINST THE MIL ACFT. I WAS ADVISED THAT THE MIL ACFT HAD DEPARTED NORTH ISLAND ARPT. I WAS ADVISED THAT THE PRELIMINARY FINDINGS INDICATED THAT THE ACFT PASSED 1 MI VERTICALLY AND 200 FT ABOVE US. OUR ACFT PROCEEDED TO SAN AND LANDED WITHOUT FURTHER INCIDENT.
