Narrative:

FL280 and noticed visually a converging target climbing 1200 ft below. Target continued climbing and converging. There was no notice given by ATC. Inquiry to ATC was stepped on, and we made another inquiry just as we received a climb RA. At that time, the TCASII read a 700 ft difference, and ATC responded the traffic was level at FL270. With visual contact, we remained at FL280, but had made a 20 degree left turn to avoid direct convergence. We did not deviation from the airway, and turned back on course. A more timely notification, or any notification, from ATC would have been appreciated and possibly avoided this RA.

Title: AN ACFT APCHING IN VISUAL CONDITIONS FROM BELOW IN CLASS A AIRSPACE CAUSES A TCASII RA THAT IS NOT FOLLOWED.

Narrative: FL280 AND NOTICED VISUALLY A CONVERGING TARGET CLBING 1200 FT BELOW. TARGET CONTINUED CLBING AND CONVERGING. THERE WAS NO NOTICE GIVEN BY ATC. INQUIRY TO ATC WAS STEPPED ON, AND WE MADE ANOTHER INQUIRY JUST AS WE RECEIVED A CLB RA. AT THAT TIME, THE TCASII READ A 700 FT DIFFERENCE, AND ATC RESPONDED THE TFC WAS LEVEL AT FL270. WITH VISUAL CONTACT, WE REMAINED AT FL280, BUT HAD MADE A 20 DEG L TURN TO AVOID DIRECT CONVERGENCE. WE DID NOT DEV FROM THE AIRWAY, AND TURNED BACK ON COURSE. A MORE TIMELY NOTIFICATION, OR ANY NOTIFICATION, FROM ATC WOULD HAVE BEEN APPRECIATED AND POSSIBLY AVOIDED THIS RA.
