Narrative:

We were departing cvg pepper airport, va, en route to gai. Leesburg FSS advised to contact potomac approach to open the ADIZ flight plan upon reaching csn, just outside the washington, dc, ADIZ. At 3 mi south of csn, while flying at 1500 ft AGL, I contacted pct requesting to open our ADIZ flight plan to gaithersburg. The controller informed us she did not have our flight plan, and we were not in the system. We attempted to stay clear of the ADIZ, while still flying a west, northwest heading at 1500 ft AGL. We were using a GPS in an attempt to move to a different pct quadrant and controller, yet still staying clear, I believed, of the ADIZ. Pct provided a squawk code. Shortly after receiving the squawk code, pct requested we have a 'pen and paper ready.' I responded to pct and asked they 'stand by.' I informed them I was ready to copy. At that time, I was told to communication a phone number. We were cleared to gaithersburg through the class B airspace and call after landing. Then, after landing at montgomery county airpark, I immediately contacted the number provided, and got the same controller, who advised me he was the shift supervisor. He further informed me that, when I contacted him near upperville, va, I was at that time 4 mi inside the ADIZ. The upperville, va, area is located at the far northwest corner of the washington dc ADIZ. He told me he had to file a 'pilot deviation' report, and that flight standards would be contacting me. When I explained the circumstances and asked why I was not in the system, when I believed my window for opening a flight plan was 1 hour before scheduled departure time, he informed me that an ADIZ window for opening a flight plan is 20 min before, until 2 hours after, scheduled departure time. At that time, he asked me for my name, address, and telephone number, which I provided. I believe providing the same window for opening an ADIZ flight plan (1 hour vice 20 mins) as for a VFR flight plan (1 hour before) would have prevented this alleged infraction. While we were well outside the washington, dc, ADIZ, south of casanova, we attempted to correctly activate our ADIZ flight plan, which pct did not have. If the 1 hour opening flight plan rule had been applicable, this alleged incident probably would not have happened.

WE WERE USING A GPS IN AN ATTEMPT TO MOVE TO A DIFFERENT PCT QUADRANT AND CTLR, YET STILL STAYING CLR, I BELIEVED, OF THE ADIZ. PCT PROVIDED A SQUAWK CODE. SHORTLY AFTER RECEIVING THE SQUAWK CODE, PCT REQUESTED WE HAVE A 'PEN AND PAPER READY.' I RESPONDED TO PCT AND ASKED THEY 'STAND BY.' I INFORMED THEM I WAS READY TO COPY. AT THAT TIME, I WAS TOLD TO COM A PHONE NUMBER. WE WERE CLRED TO GAITHERSBURG THROUGH THE CLASS B AIRSPACE AND CALL AFTER LNDG. THEN, AFTER LNDG AT MONTGOMERY COUNTY AIRPARK, I IMMEDIATELY CONTACTED THE NUMBER PROVIDED, AND GOT THE SAME CTLR, WHO ADVISED ME HE WAS THE SHIFT SUPVR. HE FURTHER INFORMED ME THAT, WHEN I CONTACTED HIM NEAR UPPERVILLE, VA, I WAS AT THAT TIME 4 MI INSIDE THE ADIZ. THE UPPERVILLE, VA, AREA IS LOCATED AT THE FAR NW CORNER OF THE WASHINGTON DC ADIZ. HE TOLD ME HE HAD TO FILE A 'PLT DEV' RPT, AND THAT FLT STANDARDS WOULD BE CONTACTING ME. WHEN I EXPLAINED THE CIRCUMSTANCES AND ASKED WHY I WAS NOT IN THE SYS, WHEN I BELIEVED MY WINDOW FOR OPENING A FLT PLAN WAS 1 HR BEFORE SCHEDULED DEP TIME, HE INFORMED ME THAT AN ADIZ WINDOW FOR OPENING A FLT PLAN IS 20 MIN BEFORE, UNTIL 2 HRS AFTER, SCHEDULED DEP TIME. AT THAT TIME, HE ASKED ME FOR MY NAME, ADDRESS, AND TELEPHONE NUMBER, WHICH I PROVIDED. I BELIEVE PROVIDING THE SAME WINDOW FOR OPENING AN ADIZ FLT PLAN (1 HR VICE 20 MINS) AS FOR A VFR FLT PLAN (1 HR BEFORE) WOULD HAVE PREVENTED THIS ALLEGED INFRACTION. WHILE WE WERE WELL OUTSIDE THE WASHINGTON, DC, ADIZ, S OF CASANOVA, WE ATTEMPTED TO CORRECTLY ACTIVATE OUR ADIZ FLT PLAN, WHICH PCT DID NOT HAVE. IF THE 1 HR OPENING FLT PLAN RULE HAD BEEN APPLICABLE, THIS ALLEGED INCIDENT PROBABLY WOULD NOT HAVE HAPPENED.
