Narrative:

Upon picking up the overnighting aircraft during the first flight of the day items, the main landing gear bay overheat failed to test. Maintenance notified dispatch and maintenance conferred with each other and it was decided to defer it under MEL 26-14-01. Dispatch sent us, via facsimile, takeoff/climb data for leaving the landing gear down for 10 mins. In the MEL, there was no mention of gear extended speed limitation or retraction limitation. We briefed and noted brake temperatures before takeoff. The inboard and outboard on the left side indicated '01.' the right inboard and outboard indicated '02' on takeoff. After 2 mins, all the brakes indicated '01.' we climbed to 1500 ft at 200 KTS before 10 mins expired. I kept the pitch up due to leaving eastbound over the atlantic before getting a westerly turn. This is below the 250 KT/70 restr in the climb. Also, I kept at 200 KTS since I needed to retract the gear at 200 KTS. However, after 10 mins, the MEL stated #3, 'if the temperature indications are equal to or greater than the temperature indicated recorded before takeoff, land at the nearest suitable airport.' we continued since the left side indicated '01' the entire time and readouts never read below '01.' so these brake temperatures could not be any lower. We continued to ZZZ without further incident. It would be a good idea to include limitation on gear speed in the MEL. Also, to add or reword part #3, after 10 mins, to state if the brake were at '01' and remained at '01,' the flight could continue.

IT WOULD BE A GOOD IDEA TO INCLUDE LIMITATION ON GEAR SPD IN THE MEL. ALSO, TO ADD OR REWORD PART #3, AFTER 10 MINS, TO STATE IF THE BRAKE WERE AT '01' AND REMAINED AT '01,' THE FLT COULD CONTINUE.
