Narrative:
Landed runway 12R at sjc. Exited runway 12R at taxiway right. As we were clearing runway 12R tower instructed us to 'cross runway 12L, taxiway Y, taxiway J to the gate.' both captain and first officer acknowledged 'cleared to cross runway 12L' to each other. Captain called 'flaps up' and first officer started after landing flow. Approaching runway 12L first officer looked right and stated 'clear right' and looked left. Captain was looking left and at the same instance stopped the aircraft abruptly and stated 'this guy is rolling,' referring to the aircraft beginning takeoff roll on runway 12L. Captain stopped the aircraft well short of the runway 12L, but was over the hold short line by approximately 5-10 ft. After our aircraft had stopped, the tower controller stated 'company number, hold position.' aircraft on takeoff roll was approximately 200-300 ft airborne abeam our position. If the departing aircraft would have been still on the ground abeam our position, I believe there would have been no danger of collision between the 2 aircraft. Captain called the tower after postflt.

Narrative: LANDED RWY 12R AT SJC. EXITED RWY 12R AT TXWY R. AS WE WERE CLRING RWY 12R TWR INSTRUCTED US TO 'CROSS RWY 12L, TXWY Y, TXWY J TO THE GATE.' BOTH CAPT AND FO ACKNOWLEDGED 'CLRED TO CROSS RWY 12L' TO EACH OTHER. CAPT CALLED 'FLAPS UP' AND FO STARTED AFTER LNDG FLOW. APCHING RWY 12L FO LOOKED R AND STATED 'CLR R' AND LOOKED L. CAPT WAS LOOKING L AND AT THE SAME INSTANCE STOPPED THE ACFT ABRUPTLY AND STATED 'THIS GUY IS ROLLING,' REFERRING TO THE ACFT BEGINNING TKOF ROLL ON RWY 12L. CAPT STOPPED THE ACFT WELL SHORT OF THE RWY 12L, BUT WAS OVER THE HOLD SHORT LINE BY APPROX 5-10 FT. AFTER OUR ACFT HAD STOPPED, THE TWR CTLR STATED 'COMPANY NUMBER, HOLD POS.' ACFT ON TKOF ROLL WAS APPROX 200-300 FT AIRBORNE ABEAM OUR POS. IF THE DEPARTING ACFT WOULD HAVE BEEN STILL ON THE GND ABEAM OUR POS, I BELIEVE THERE WOULD HAVE BEEN NO DANGER OF COLLISION BTWN THE 2 ACFT. CAPT CALLED THE TWR AFTER POSTFLT.
