Narrative:

During a noise abatement takeoff; runway 24 teb; on the teb 5 departure (SID); we climbed on runway heading per the SID; and started the charted route to 280 degrees. At this point; we prematurely continued to climb to 2000 ft prior to the 4.5 DME fix off of teb VOR. Note: we were assigned 2000 ft in the clearance. At this point; the departure controller then reminded us we should be at 1500 ft. We immediately returned to 1500 ft and continued the departure with no further incident. Contributing factors: 1) 12.5 hour duty day at that point. 2) distracted by performing a noise abatement takeoff during critical phase of flight. 3) given 2000 ft in clearance; potentially confusing when compared to departure. Suggestion: ATC should initially clear aircraft to 1500 ft then issue the climb. Supplemental information from acn 647731: our initial clearance was to 2000 ft which was put in the altitude selector. This caused the flight director to not capture at 1500 ft. We were at about 12.5 hours duty time at the time of occurrence.

Title: FLT CREW OF H125 ON TEB DEP FAIL TO MAINTAIN 1500 FT PER PROC. CLB TO 2000 FT GIVEN IN PRE DEP CLRNC.

Narrative: DURING A NOISE ABATEMENT TKOF; RWY 24 TEB; ON THE TEB 5 DEP (SID); WE CLBED ON RWY HDG PER THE SID; AND STARTED THE CHARTED RTE TO 280 DEGS. AT THIS POINT; WE PREMATURELY CONTINUED TO CLB TO 2000 FT PRIOR TO THE 4.5 DME FIX OFF OF TEB VOR. NOTE: WE WERE ASSIGNED 2000 FT IN THE CLRNC. AT THIS POINT; THE DEP CTLR THEN REMINDED US WE SHOULD BE AT 1500 FT. WE IMMEDIATELY RETURNED TO 1500 FT AND CONTINUED THE DEP WITH NO FURTHER INCIDENT. CONTRIBUTING FACTORS: 1) 12.5 HR DUTY DAY AT THAT POINT. 2) DISTRACTED BY PERFORMING A NOISE ABATEMENT TKOF DURING CRITICAL PHASE OF FLT. 3) GIVEN 2000 FT IN CLRNC; POTENTIALLY CONFUSING WHEN COMPARED TO DEP. SUGGESTION: ATC SHOULD INITIALLY CLR ACFT TO 1500 FT THEN ISSUE THE CLB. SUPPLEMENTAL INFO FROM ACN 647731: OUR INITIAL CLRNC WAS TO 2000 FT WHICH WAS PUT IN THE ALT SELECTOR. THIS CAUSED THE FLT DIRECTOR TO NOT CAPTURE AT 1500 FT. WE WERE AT ABOUT 12.5 HRS DUTY TIME AT THE TIME OF OCCURRENCE.
