Narrative:

Departure teb on the teb 5 departure. We were leveling at 1500 ft and turning right to heading 280 degree. When we checked in with departure control we advised 1500 ft for 2000 ft. The SID says to climb on runway heading (240 degrees) to 1500 ft then turn right to heading 280 degrees passing teb 4.5 DME climb to 2000 ft. We believe the controller thought we were climbing to 2000 ft because he advised traffic overhead at 3000 ft for ewr and that the departure says maintain 1500 ft until 4.5 teb DME. We were at our assigned altitude per the SID and believe the problem to be phraseology and misunderstanding on the first radio contact. We believe with proper phraseology these problems will reduce in quantity.

Narrative: DEP TEB ON THE TEB 5 DEP. WE WERE LEVELING AT 1500 FT AND TURNING R TO HDG 280 DEG. WHEN WE CHKED IN WITH DEP CTL WE ADVISED 1500 FT FOR 2000 FT. THE SID SAYS TO CLB ON RWY HDG (240 DEGS) TO 1500 FT THEN TURN R TO HDG 280 DEGS PASSING TEB 4.5 DME CLB TO 2000 FT. WE BELIEVE THE CTLR THOUGHT WE WERE CLBING TO 2000 FT BECAUSE HE ADVISED TFC OVERHEAD AT 3000 FT FOR EWR AND THAT THE DEP SAYS MAINTAIN 1500 FT UNTIL 4.5 TEB DME. WE WERE AT OUR ASSIGNED ALT PER THE SID AND BELIEVE THE PROB TO BE PHRASEOLOGY AND MISUNDERSTANDING ON THE FIRST RADIO CONTACT. WE BELIEVE WITH PROPER PHRASEOLOGY THESE PROBS WILL REDUCE IN QUANTITY.
