Narrative:

Aircraft #2 was landing ach from the west. He was descending from FL390. I issued a clearance to FL200 and expedite through FL290. Aircraft #1 was heading southwest climbing to FL380. I asked him to expedite through FL350. I then turned the aircraft #2 20 degrees right and aircraft #1 20 degrees right. The conflict alert went off and I turned both aircraft 40 degrees right and told them to expedite. After reviewing the tapes and 'mcass' it appeared that both aircraft flattened off the climb and descent. The radar was also not receiving mode C prior to this.

Title: ZNY CTLR EXPERIENCED OPERROR AT FL320 WHEN ACTION TAKEN TO SEPARATION CLBING AND DSNDING ACFT WAS NOT TIMELY.

Narrative: ACFT #2 WAS LNDG ACH FROM THE W. HE WAS DSNDING FROM FL390. I ISSUED A CLRNC TO FL200 AND EXPEDITE THROUGH FL290. ACFT #1 WAS HDG SW CLBING TO FL380. I ASKED HIM TO EXPEDITE THROUGH FL350. I THEN TURNED THE ACFT #2 20 DEGS R AND ACFT #1 20 DEGS R. THE CONFLICT ALERT WENT OFF AND I TURNED BOTH ACFT 40 DEGS R AND TOLD THEM TO EXPEDITE. AFTER REVIEWING THE TAPES AND 'MCASS' IT APPEARED THAT BOTH ACFT FLATTENED OFF THE CLB AND DSCNT. THE RADAR WAS ALSO NOT RECEIVING MODE C PRIOR TO THIS.
