Narrative:

Our aircraft had an FMS database that was out of date and was deferred. The flight plan was correctly filed with an equipment code of '/west.' however; the filed flight plan showed the CADIT4 departure which is an RNAV departure. MEL states that I must be able to verify waypoints using ground based system. Pure RNAV waypoints like on the CADIT4 can't be verified using that method. When my first officer requested our clearance the clearance we received already had the CADIT4 removed from it by ATC. As a result there was no action required on our part to remove it; and a potential safety/violation issue was avoided.

Title: EMB145 FLT CREW HAS OUT OF DATE FMS DATABASE.

Narrative: OUR ACFT HAD AN FMS DATABASE THAT WAS OUT OF DATE AND WAS DEFERRED. THE FLT PLAN WAS CORRECTLY FILED WITH AN EQUIP CODE OF '/W.' HOWEVER; THE FILED FLT PLAN SHOWED THE CADIT4 DEP WHICH IS AN RNAV DEP. MEL STATES THAT I MUST BE ABLE TO VERIFY WAYPOINTS USING GND BASED SYS. PURE RNAV WAYPOINTS LIKE ON THE CADIT4 CAN'T BE VERIFIED USING THAT METHOD. WHEN MY FO REQUESTED OUR CLRNC THE CLRNC WE RECEIVED ALREADY HAD THE CADIT4 REMOVED FROM IT BY ATC. AS A RESULT THERE WAS NO ACTION REQUIRED ON OUR PART TO REMOVE IT; AND A POTENTIAL SAFETY/VIOLATION ISSUE WAS AVOIDED.
