Narrative:

On approach to oak, captain observed aircraft takeoff from hayward airport. I advised captain to keep him in sight since aircraft off hayward have a tendency to make a downwind departure right up the localizer. That is exactly what happen. An small aircraft made a left turn out and made a downwind departure right up the localizer. Oak tower never advised us of the traffic due I think to an aircraft on a missed approach from oak that had flown the wrong procedure. On ground I called both oak and hayward tower and I got the feeling that they are aware of problem, but have territorial claims that they are not willing to give up. The aircraft passed within 200' of our aircraft and directly below.

Title: ACR MLG ON APCH TO OAK CAME IN CLOSE PROX WITH HAYWARD DEP ON DOWNWIND DEP.

Narrative: ON APCH TO OAK, CAPT OBSERVED ACFT TKOF FROM HAYWARD ARPT. I ADVISED CAPT TO KEEP HIM IN SIGHT SINCE ACFT OFF HAYWARD HAVE A TENDENCY TO MAKE A DOWNWIND DEP RIGHT UP THE LOC. THAT IS EXACTLY WHAT HAPPEN. AN SMA MADE A LEFT TURN OUT AND MADE A DOWNWIND DEP RIGHT UP THE LOC. OAK TWR NEVER ADVISED US OF THE TFC DUE I THINK TO AN ACFT ON A MISSED APCH FROM OAK THAT HAD FLOWN THE WRONG PROC. ON GND I CALLED BOTH OAK AND HAYWARD TWR AND I GOT THE FEELING THAT THEY ARE AWARE OF PROB, BUT HAVE TERRITORIAL CLAIMS THAT THEY ARE NOT WILLING TO GIVE UP. THE ACFT PASSED WITHIN 200' OF OUR ACFT AND DIRECTLY BELOW.
