Narrative:

Shortly after take off; a spoiler fail message was presented on our EICAS. After complying with the aom procedures for a spoiler fail message and being further directed by that procedure to apply the emergency procedure 'inadvertent spoiler opening in flight' procedure; we declared a precautionary emergency with ATC and company operations and made a planned 300 lb overweight landing. After landing; aml entries were made for both the spoiler fail event and the overweight landing. It was noted that this spoiler fail event was the third such event logged for this tail number today. The aom touchdown criteria for a safe overweight landing was followed and the aircraft landed normally and softly with a less than 300 fpm rate of descent.

Title: Following receipt of the aircraft's third SPOILER FAIL EICAS message of the day; the flight crew of an EMB145 declared an emergency and returned to the departure airport for an overweight landing.
