Narrative:
I was working the erick position at the ny TRACON and accepted a handoff on aircraft small aircraft X climbing out of 5000-6000' when I noticed a tag at 5000' moving eastbound in front of small aircraft X. I called the traffic and the pilot reported he did not see the other aircraft. I then asked small aircraft X to increase his rate of climb to get above the other aircraft. Small aircraft X was on a random route when he was supposed to be on V16. Callback conversation with reporter revealed the following: reporter took the handoff on small aircraft X when the aircraft was some distance outside his airspace boundary headed toward his airspace. The transferring controller failed to assure sep between small aircraft and small transport Y before he transferred the small aircraft to reporter's frequency. Small aircraft X was climbing to 6000' but did not reach that altitude before latitude sep was lost with small transport Y at 5000'. Reporter was exonerated of any blame in this system error.

Title: LESS THAN STANDARD SEPARATION WHEN SMA CLIMBED THROUGH THE ALT OF SMT AND LATERAL SEPARATION NOT MAINTAINED.
Narrative: I WAS WORKING THE ERICK POS AT THE NY TRACON AND ACCEPTED A HDOF ON ACFT SMA X CLBING OUT OF 5000-6000' WHEN I NOTICED A TAG AT 5000' MOVING EBND IN FRONT OF SMA X. I CALLED THE TFC AND THE PLT RPTED HE DID NOT SEE THE OTHER ACFT. I THEN ASKED SMA X TO INCREASE HIS RATE OF CLB TO GET ABOVE THE OTHER ACFT. SMA X WAS ON A RANDOM RTE WHEN HE WAS SUPPOSED TO BE ON V16. CALLBACK CONVERSATION WITH RPTR REVEALED THE FOLLOWING: RPTR TOOK THE HDOF ON SMA X WHEN THE ACFT WAS SOME DISTANCE OUTSIDE HIS AIRSPACE BOUNDARY HEADED TOWARD HIS AIRSPACE. THE TRANSFERRING CTLR FAILED TO ASSURE SEP BTWN SMA AND SMT Y BEFORE HE TRANSFERRED THE SMA TO RPTR'S FREQ. SMA X WAS CLBING TO 6000' BUT DID NOT REACH THAT ALT BEFORE LAT SEP WAS LOST WITH SMT Y AT 5000'. RPTR WAS EXONERATED OF ANY BLAME IN THIS SYS ERROR.
