Narrative:
Clearance after takeoff was rh maintain 5000' MSL runway 23 at norfolk. At 1000' MSL advised by tower to expedite climb through 3500' MSL. Due to traffic at 12 O'clock at 2500' MSL moving right to left. At that time the traffic was sighted and a right turn was made to avoid same. Approximately 20 degree heading change to the right. Immediately after takeoff the aircraft is climbing at maximum rate of climb therefore a clearance to expedite climb is inappropriate. Takeoff clearance should not have been issued or a turn clearance should have been issued. Supplemental information from acn 97458. Captain made comment to tower about the close approach. Tower indicated that he was 'aware of the traffic.'

Title: CONFLICT AIRBORNE BETWEEN DEPARTING ACR-MLG AND UNKNOWN ACFT IN PATTERN. OPDEV.
Narrative: CLRNC AFTER TKOF WAS RH MAINTAIN 5000' MSL RWY 23 AT NORFOLK. AT 1000' MSL ADVISED BY TWR TO EXPEDITE CLB THROUGH 3500' MSL. DUE TO TFC AT 12 O'CLOCK AT 2500' MSL MOVING RIGHT TO LEFT. AT THAT TIME THE TFC WAS SIGHTED AND A RIGHT TURN WAS MADE TO AVOID SAME. APPROX 20 DEG HDG CHANGE TO THE RIGHT. IMMEDIATELY AFTER TKOF THE ACFT IS CLBING AT MAX RATE OF CLB THEREFORE A CLRNC TO EXPEDITE CLB IS INAPPROPRIATE. TKOF CLRNC SHOULD NOT HAVE BEEN ISSUED OR A TURN CLRNC SHOULD HAVE BEEN ISSUED. SUPPLEMENTAL INFO FROM ACN 97458. CAPT MADE COMMENT TO TWR ABOUT THE CLOSE APCH. TWR INDICATED THAT HE WAS 'AWARE OF THE TFC.'
