Narrative:

After takeoff the nose wheel failed to retract; it continued to cycle until a gear disagree warning displayed. We complied with the QRH and returned to our departure airport. The gear was down and indicated locked so we took delay vectors to burn fuel. Because we had a gear down and lock indication when we put the gear down we elected not to declare an emergency. We did end up landing approximately 500 pounds overweight for which I exercised my emergency authority. Landing was safer than doing a go around.the problem is the aircraft had been written up multiple times in the past for the same problem. The mechanics wanted to adjust the nose proximity sensor again. I told them this was a recurring problem and entered in the maintenance log that it was a repeat write up.our -200 fleet is not maintained properly!!!! Landing gear failures should not happen multiple times. I suggest we don't fly aircraft that are not maintained properly.
