Narrative:
I received my clearance from mci to ojc, an altitude of 2500' and departure frequency of 124.7. I was then cleared by ground to taxi from GA to runway 19. As I approached the intersection of taxiway bravo I was converging at the same time with a jetliner. I stopped to give him right of way and let him ahead of me, but ground control advised me that I was to continue in front of him and that he would have to wait for me, as I was cleared ahead of him. This, I believe, must have made him a little aggravated as he seemed to taxi very close behind me. I did my runup while taxiing, as to not hold up the jet behind me when I arrived at the approach end of 19. Upon arriving at that point, I switched to the tower frequency but could get no answer. I tried unsuccessfully, then switched back to ground and tried with no results. I could break the squelch on the radios and could hear the noise, but absolutely no voice communication. The transmit light would illuminate when depressing the microphone button indicating transmission, but no response. I even tried switching to departure frequency with no results either. The pilot in the jet behind me kept flashing his lights at me. Knowing he was in a hurry and was upset with me was very distracting. He started gunning his engines and inching up my tail, all the while with his landing lights flashing at me. I looked back to see how I could turn around and all I could see was a large engine shroud. My intention was to get out of his way but he was too close to me for me to do anything but go straight ahead. I looked at the tower for a light but saw nothing. I then noticed that runway 19 approach was clear and decided to cross over the runway and wait on the other side. As I taxied across the approach end I noticed to my horror that there was no taxiway or runup pad on the other side. (This was my first time at this airport was was unfamiliar with the field.) as I looked back for a place to escape the jet flashed his lights again in rapid succession and the thought occurred to me that maybe he was trying to tell me that the tower had cleared me for takeoff. Also the thoughtoccurred about the rule of continuing as cleared when losing radio contact. I do realize now that rule is while flying, not on the ground. However, with the jet pilot harassing me and pushing me like he was it was hard to do any amount of intelligent thinking. The only thing I knew to do was to get out of his way the safest and quickest way I could. I felt that since I was now out on the runway, I had no choice but to go ahead and make a takeoff and get out of his way. I feel that he has absolutely no business flying an aircraft if he is going to harass others and cause an unsafe situation. I went ahead with my takeoff after making sure there was no traffic either on 19 or on the cross runway. After climbing to 2500' I was able to reach departure control and I immediately notified them of my problem on the ground. I was told to phone ATC upon landing at ojc. The gentleman I spoke with was very nice and just wanted to know what happened. I explained the situation to him and he indicated that probably nothing would come of it, but that he would consult with his superiors. I phoned him back in an hour at his request and was told that he had to write it up 'just in case the airlines complained.' I decided that it's about time I stand up for my rights! Why should the airlines complain? I'm the one who should be complaining. I'm the one who was harassed. I'm the one who was literally forced out on the runway with no way to retreat! I have just as much right to be there as he does. Why do I have to be written up 'just in case the airlines complain?' would the airlines be written up 'just in case a small private airplane complained' about something he did? Especially since the airlines are the ones who in my opinion have caused this fiasco in the first place. I realize he does have a schedule to keep. That is one reason I wanted to let him taxi in front of me. It he has such a short temper as to let something that small upset him, in my opinion, he shouldn't be flying an aircraft. I feel that I acted the only way I knew how to get outof his way. I could have taxied down the runway, but being unfamiliar with the airfield, I didn't know how far it was to the turnoff and while already on the active, I might as well get out of his way. Callback conversation with reporter revealed the following: reporter has not received any further information reference the incident. Has not had any problems with the radios since the incident. Realizes he would have better to proceed down the runway and clear at the first taxiway. Under the conditions he just wanted to get out of the way.
Original NASA ASRS Text
Title: TKOF WITHOUT CLRNC.
Narrative: I RECEIVED MY CLRNC FROM MCI TO OJC, AN ALT OF 2500' AND DEP FREQ OF 124.7. I WAS THEN CLRED BY GND TO TAXI FROM GA TO RWY 19. AS I APCHED THE INTXN OF TXWY BRAVO I WAS CONVERGING AT THE SAME TIME WITH A JETLINER. I STOPPED TO GIVE HIM RIGHT OF WAY AND LET HIM AHEAD OF ME, BUT GND CTL ADVISED ME THAT I WAS TO CONTINUE IN FRONT OF HIM AND THAT HE WOULD HAVE TO WAIT FOR ME, AS I WAS CLRED AHEAD OF HIM. THIS, I BELIEVE, MUST HAVE MADE HIM A LITTLE AGGRAVATED AS HE SEEMED TO TAXI VERY CLOSE BEHIND ME. I DID MY RUNUP WHILE TAXIING, AS TO NOT HOLD UP THE JET BEHIND ME WHEN I ARRIVED AT THE APCH END OF 19. UPON ARRIVING AT THAT POINT, I SWITCHED TO THE TWR FREQ BUT COULD GET NO ANSWER. I TRIED UNSUCCESSFULLY, THEN SWITCHED BACK TO GND AND TRIED WITH NO RESULTS. I COULD BREAK THE SQUELCH ON THE RADIOS AND COULD HEAR THE NOISE, BUT ABSOLUTELY NO VOICE COM. THE XMIT LIGHT WOULD ILLUMINATE WHEN DEPRESSING THE MIC BUTTON INDICATING XMISSION, BUT NO RESPONSE. I EVEN TRIED SWITCHING TO DEP FREQ WITH NO RESULTS EITHER. THE PLT IN THE JET BEHIND ME KEPT FLASHING HIS LIGHTS AT ME. KNOWING HE WAS IN A HURRY AND WAS UPSET WITH ME WAS VERY DISTRACTING. HE STARTED GUNNING HIS ENGS AND INCHING UP MY TAIL, ALL THE WHILE WITH HIS LNDG LIGHTS FLASHING AT ME. I LOOKED BACK TO SEE HOW I COULD TURN AROUND AND ALL I COULD SEE WAS A LARGE ENG SHROUD. MY INTENTION WAS TO GET OUT OF HIS WAY BUT HE WAS TOO CLOSE TO ME FOR ME TO DO ANYTHING BUT GO STRAIGHT AHEAD. I LOOKED AT THE TWR FOR A LIGHT BUT SAW NOTHING. I THEN NOTICED THAT RWY 19 APCH WAS CLR AND DECIDED TO CROSS OVER THE RWY AND WAIT ON THE OTHER SIDE. AS I TAXIED ACROSS THE APCH END I NOTICED TO MY HORROR THAT THERE WAS NO TXWY OR RUNUP PAD ON THE OTHER SIDE. (THIS WAS MY FIRST TIME AT THIS ARPT WAS WAS UNFAMILIAR WITH THE FIELD.) AS I LOOKED BACK FOR A PLACE TO ESCAPE THE JET FLASHED HIS LIGHTS AGAIN IN RAPID SUCCESSION AND THE THOUGHT OCCURRED TO ME THAT MAYBE HE WAS TRYING TO TELL ME THAT THE TWR HAD CLRED ME FOR TKOF. ALSO THE THOUGHTOCCURRED ABOUT THE RULE OF CONTINUING AS CLRED WHEN LOSING RADIO CONTACT. I DO REALIZE NOW THAT RULE IS WHILE FLYING, NOT ON THE GND. HOWEVER, WITH THE JET PLT HARASSING ME AND PUSHING ME LIKE HE WAS IT WAS HARD TO DO ANY AMOUNT OF INTELLIGENT THINKING. THE ONLY THING I KNEW TO DO WAS TO GET OUT OF HIS WAY THE SAFEST AND QUICKEST WAY I COULD. I FELT THAT SINCE I WAS NOW OUT ON THE RWY, I HAD NO CHOICE BUT TO GO AHEAD AND MAKE A TKOF AND GET OUT OF HIS WAY. I FEEL THAT HE HAS ABSOLUTELY NO BUSINESS FLYING AN ACFT IF HE IS GOING TO HARASS OTHERS AND CAUSE AN UNSAFE SITUATION. I WENT AHEAD WITH MY TKOF AFTER MAKING SURE THERE WAS NO TFC EITHER ON 19 OR ON THE CROSS RWY. AFTER CLBING TO 2500' I WAS ABLE TO REACH DEP CTL AND I IMMEDIATELY NOTIFIED THEM OF MY PROB ON THE GND. I WAS TOLD TO PHONE ATC UPON LNDG AT OJC. I PHONED HIM BACK IN AN HR AT HIS REQUEST AND WAS TOLD THAT HE HAD TO WRITE IT UP 'JUST IN CASE THE AIRLINES COMPLAINED.' I DECIDED THAT IT'S ABOUT TIME I STAND UP FOR MY RIGHTS! WHY SHOULD THE AIRLINES COMPLAIN? I'M THE ONE WHO SHOULD BE COMPLAINING. I'M THE ONE WHO WAS HARASSED. I'M THE ONE WHO WAS LITERALLY FORCED OUT ON THE RWY WITH NO WAY TO RETREAT! I HAVE JUST AS MUCH RIGHT TO BE THERE AS HE DOES. WHY DO I HAVE TO BE WRITTEN UP 'JUST IN CASE THE AIRLINES COMPLAIN?' WOULD THE AIRLINES BE WRITTEN UP 'JUST IN CASE A SMALL PVT AIRPLANE COMPLAINED' ABOUT SOMETHING HE DID? ESPECIALLY SINCE THE AIRLINES ARE THE ONES WHO IN MY OPINION HAVE CAUSED THIS FIASCO IN THE FIRST PLACE. I REALIZE HE DOES HAVE A SCHEDULE TO KEEP. THAT IS ONE REASON I WANTED TO LET HIM TAXI IN FRONT OF ME. IT HE HAS SUCH A SHORT TEMPER AS TO LET SOMETHING THAT SMALL UPSET HIM, IN MY OPINION, HE SHOULDN'T BE FLYING AN ACFT. I FEEL THAT I ACTED THE ONLY WAY I KNEW HOW TO GET OUTOF HIS WAY. I COULD HAVE TAXIED DOWN THE RWY, BUT BEING UNFAMILIAR WITH THE AIRFIELD, I DIDN'T KNOW HOW FAR IT WAS TO THE TURNOFF AND WHILE ALREADY ON THE ACTIVE, I MIGHT AS WELL GET OUT OF HIS WAY. CALLBACK CONVERSATION WITH RPTR REVEALED THE FOLLOWING: RPTR HAS NOT RECEIVED ANY FURTHER INFO REF THE INCIDENT. HAS NOT HAD ANY PROBS WITH THE RADIOS SINCE THE INCIDENT. REALIZES HE WOULD HAVE BETTER TO PROCEED DOWN THE RWY AND CLR AT THE FIRST TXWY. UNDER THE CONDITIONS HE JUST WANTED TO GET OUT OF THE WAY.
