Narrative:
We received clearance prior to taxi at sjc: 'loupe 7 (SID), rbl transition, then as filed, climb and maintain FL230, squawk 4224, bay departure 121.3, do not exceed 250 KTS until advised.' as we departed sjc runway 30L, we flew to the 1.8 DME fix and started our turn to 120 degree heading. At the 020 degree right, the copilot questioned altitude limit FL230 or 5000', and I asked him to verify, as we were climbing through 5000' at that time. Copilot reconfirmed 5000' restriction. I took immediate action, stopped climb at 5500' and descended back down to 5000' MSL. Bay departure also confirmed this, as they showed us above 5000' with traffic 10-11 O'clock, 2000-3000' above and 6-7 mi. We continued to fly the SID, adhering to published and ATC restrictions. We continued our flight to redding as planned with no further problems. I then called the bay approach supervisor and talked to him about the occurrence. He said it happens frequently at sjc and requested I fill out this form. This situation should not have occurred, however it did. A possible solution to this type of problem, which happens frequently at sjc, would be not to assign any altitude, other than that published on the SID.

Narrative: WE RECEIVED CLRNC PRIOR TO TAXI AT SJC: 'LOUPE 7 (SID), RBL TRANSITION, THEN AS FILED, CLB AND MAINTAIN FL230, SQUAWK 4224, BAY DEP 121.3, DO NOT EXCEED 250 KTS UNTIL ADVISED.' AS WE DEPARTED SJC RWY 30L, WE FLEW TO THE 1.8 DME FIX AND STARTED OUR TURN TO 120 DEG HDG.
