Narrative:

I was captain on flight from ewr to pit, 5/90. First officer had received ATC departure clearance, standard ewr SID for runway 4L. Left the gate, taxied to 4L, with running checklist. At departure briefing point 9 checked initial heading, radios, transponder code and altitude. First officer stated clearance was to maintain 5000'. After takeoff turned to 060 degree heading and were handed off to departure control. Upon switching we were unable to contact due to frequency congestion. At that point we were crossing the canarsie VOR radial fix when I began a left turn to 290 degrees as called for by SID and continued climbing out of 4000'. First officer was able to contact departure giving altitude climbing to. Departure control returned with our clearance was only to 2500' and to make an immediate left turn to 290 degrees (which we had already initiated) and continue to 5000'. Moments later clearance to 8000' given and complied with along with handoff to ZNY.

AT DEP BRIEFING POINT 9 CHKED INITIAL HDG, RADIOS, XPONDER CODE AND ALT. F/O STATED CLRNC WAS TO MAINTAIN 5000'. AFTER TKOF TURNED TO 060 DEG HDG AND WERE HANDED OFF TO DEP CTL. UPON SWITCHING WE WERE UNABLE TO CONTACT DUE TO FREQ CONGESTION. AT THAT POINT WE WERE XING THE CANARSIE VOR RADIAL FIX WHEN I BEGAN A LEFT TURN TO 290 DEGS AS CALLED FOR BY SID AND CONTINUED CLBING OUT OF 4000'. F/O WAS ABLE TO CONTACT DEP GIVING ALT CLBING TO. DEP CTL RETURNED WITH OUR CLRNC WAS ONLY TO 2500' AND TO MAKE AN IMMEDIATE LEFT TURN TO 290 DEGS (WHICH WE HAD ALREADY INITIATED) AND CONTINUE TO 5000'. MOMENTS LATER CLRNC TO 8000' GIVEN AND COMPLIED WITH ALONG WITH HDOF TO ZNY.
