Narrative:

This was an far 91 flight. It is alleged by the local FSDO to be an far 135 flight. The only passenger was the owner of the aircraft, an small transport. The aircraft requires only 1 pilot. The owner did not request nor require a second pilot. I am chief pilot of a company which has the light transport on its operating certificate. I am not qualified in the aircraft. As this was an owner only far 91 flight, I went along to assist the owner as needed. There was no intent to conduct an far 135 flight.

Title: REPORTER SAYS LCL FSDO SAID A FLT HE WAS ON WITH ACFT OWNER SHOULD HAVE BEEN A PART 135 OPERATION INSTEAD OF PART 91, AS IT WAS CALLED.

Narrative: THIS WAS AN FAR 91 FLT. IT IS ALLEGED BY THE LCL FSDO TO BE AN FAR 135 FLT. THE ONLY PAX WAS THE OWNER OF THE ACFT, AN SMT. THE ACFT REQUIRES ONLY 1 PLT. THE OWNER DID NOT REQUEST NOR REQUIRE A SECOND PLT. I AM CHIEF PLT OF A COMPANY WHICH HAS THE LTT ON ITS OPERATING CERTIFICATE. I AM NOT QUALIFIED IN THE ACFT. AS THIS WAS AN OWNER ONLY FAR 91 FLT, I WENT ALONG TO ASSIST THE OWNER AS NEEDED. THERE WAS NO INTENT TO CONDUCT AN FAR 135 FLT.
