Narrative:

We were assigned and approaching 17000' on climb out from lga on a west heading. Approaching bwz, TCAS showed aircraft 12 O'clock, level 6 mi but climbing. As aircraft neared, it moved to pass off our right about 3 mi. Prior to passing, TCAS showed aircraft at 200-300' above. It also gave T/a and then an right/a commanding descent. Command was followed to 16600', where descent command ceased and aircraft passed our 3 O'clock indicating 900' above us or 17500'. We had been advised of the traffic by ATC. We advised ATC of the altitude TCAS deviation and returned to 17000'.

WE ADVISED ATC OF THE ALT TCAS DEVIATION AND RETURNED TO 17000'.
