Narrative:

Air carrier X on climb out of stl we had a near miss with an light transport air carrier Y at 3300 ft. TCASII was followed. Other aircraft was told to maintain 3000 ft, but continued climb to 4000 ft. ATC should not have turned us into that aircraft. Callback conversation with reporter revealed the following information: the reporter stated the air carrier Y had been issued as traffic and they had the aircraft in sight. The controller had not instructed them to maintain visual separation from air carrier Y. TCASII gave a TA and then an RA when air carrier Y did not stop at 3000 ft. The reporter called the supervisor at stl and was told a system error was going to be filed because the controller had not used visual separation properly. Supervisor stated the controller had been recently checked out.

Title: ACR Y NON ADHERENCE TO ATC CLRNC HAD LTSS FROM ACR X. PLTDEV. SYS ERROR.

Narrative: ACR X ON CLB OUT OF STL WE HAD A NEAR MISS WITH AN LTT ACR Y AT 3300 FT. TCASII WAS FOLLOWED. OTHER ACFT WAS TOLD TO MAINTAIN 3000 FT, BUT CONTINUED CLB TO 4000 FT. ATC SHOULD NOT HAVE TURNED US INTO THAT ACFT. CALLBACK CONVERSATION WITH RPTR REVEALED THE FOLLOWING INFO: THE RPTR STATED THE ACR Y HAD BEEN ISSUED AS TFC AND THEY HAD THE ACFT IN SIGHT. THE CTLR HAD NOT INSTRUCTED THEM TO MAINTAIN VISUAL SEPARATION FROM ACR Y. TCASII GAVE A TA AND THEN AN RA WHEN ACR Y DID NOT STOP AT 3000 FT. THE RPTR CALLED THE SUPVR AT STL AND WAS TOLD A SYS ERROR WAS GOING TO BE FILED BECAUSE THE CTLR HAD NOT USED VISUAL SEPARATION PROPERLY. SUPVR STATED THE CTLR HAD BEEN RECENTLY CHKED OUT.
