Narrative:

I was made aware that an air carrier airlines aircraft reported a near miss with an MTR type aircraft in the vicinity of the mlc 207/91 DME fix. I was flying in that area on the day of dec 91. I did not observe the air carrier aircraft or any other airliner during the time spent in the area of the mlc 207/91. I was practicing aerobatic flight between 10000 and 17500 ft MSL for approximately 15 mins. Callback conversation with reporter revealed the following information. Reporter states he was contacted by local FSDO rep who informed him about the incident. Easy to track him as home base has several 'war bird' aircraft. Outcome has been very positive. Mtgs between pilots, controllers, and FSDO personnel have outlined a specific area for this kind of activity, away from airways and approach departure rtes. A block altitude is established and a frequency to contact. Procedure is to call by phone and advise, then contact in the air for a squawk and be in communication until departing the area. FSDO determined he was legal in his flight and was squawking proper code. Supplemental information from acn 196299. Climbing out of dfw on our flight to ord we had a near midair collision with an MTR. At 17600 the so was working on cruise figures, we had been given a new airway routing and the first officer was setting his radios and I was working on my flight plan. I looked up and saw a target at 12 O'clock moving slightly then it became stationary and started to increase in size. I took control of the airplane and made a climbing left turn. As the target approached we could make it out as an MTR engaged in aerobatic flight. It was inverted and rolling. It continued toward us missing us on our right lower side. We brought the near miss to ft worth center's attention. They picked the target up descending behind us. The whole incident took about 5-6 seconds. There is no doubt in my mind that this incident was caused by irresponsible person performing aerobatics and occupying unauthorized airspace. Evidently ARTCC didn't 'see' the MTR until after it passed us. We were informed the MTR doesn't present a 'good' primary target and when he was inverted the transponder couldn't reply. My suggestion to solve or prevent this from happening is very strict enforcement, including incarceration of guilty parties.

MTGS BTWN PLTS, CTLRS, AND FSDO PERSONNEL HAVE OUTLINED A SPECIFIC AREA FOR THIS KIND OF ACTIVITY, AWAY FROM AIRWAYS AND APCH DEP RTES. A BLOCK ALT IS ESTABLISHED AND A FREQ TO CONTACT. PROC IS TO CALL BY PHONE AND ADVISE, THEN CONTACT IN THE AIR FOR A SQUAWK AND BE IN COM UNTIL DEPARTING THE AREA. FSDO DETERMINED HE WAS LEGAL IN HIS FLT AND WAS SQUAWKING PROPER CODE. I LOOKED UP AND SAW A TARGET AT 12 O'CLOCK MOVING SLIGHTLY THEN IT BECAME STATIONARY AND STARTED TO INCREASE IN SIZE. I TOOK CTL OF THE AIRPLANE AND MADE A CLBING L TURN. AS THE TARGET APCHED WE COULD MAKE IT OUT AS AN MTR ENGAGED IN AEROBATIC FLT. IT WAS INVERTED AND ROLLING. IT CONTINUED TOWARD US MISSING US ON OUR R LOWER SIDE. WE BROUGHT THE NEAR MISS TO FT WORTH CENTER'S ATTN. THEY PICKED THE TARGET UP DSNDING BEHIND US. THE WHOLE INCIDENT TOOK ABOUT 5-6 SECONDS. THERE IS NO DOUBT IN MY MIND THAT THIS INCIDENT WAS CAUSED BY IRRESPONSIBLE PERSON PERFORMING AEROBATICS AND OCCUPYING UNAUTHORIZED AIRSPACE. EVIDENTLY ARTCC DIDN'T 'SEE' THE MTR UNTIL AFTER IT PASSED US. WE WERE INFORMED THE MTR DOESN'T PRESENT A 'GOOD' PRIMARY TARGET AND WHEN HE WAS INVERTED THE TRANSPONDER COULDN'T REPLY. MY SUGGESTION TO SOLVE OR PREVENT THIS FROM HAPPENING IS VERY STRICT ENFORCEMENT, INCLUDING INCARCERATION OF GUILTY PARTIES.
