Narrative:
Air carrier X departure clearance was to 5000 ft. We made all the required turns and altitudes to the point of a 120 degree heading where the departure says to 'expect vectors' back to the sjc VOR. Controller gave no other vectors but cleared us to FL230 and gave us a ZOA frequency. That controller said we were on wrong frequency and gave us new one. Next frequency asked if we had been cleared back to VOR. We had not. By that time we were through 12.5M for 230. He had us level at 13M and told us we were supposed to cross the VOR at 12000 ft or below as per departure. The confusion came about as the departure controller left us on a heading away from the VOR and cleared us to climb to FL230 -- with no indication that we maintain 12000 ft until we were vectored back to and across the VOR before continuing to FL230.

THE CONFUSION CAME ABOUT AS THE DEP CTLR LEFT US ON A HDG AWAY FROM THE VOR AND CLRED US TO CLB TO FL230 -- WITH NO INDICATION THAT WE MAINTAIN 12000 FT UNTIL WE WERE VECTORED BACK TO AND ACROSS THE VOR BEFORE CONTINUING TO FL230.
