Narrative:

Air carrier X was en route to pdx at FL350. Air carrier Y was en route to san at FL330. Air carrier Y was climbed to FL370. When proximity was noticed (15 seconds later), air carrier Y was turned left and told to maintain FL330. 2 1/2 min later, air carrier Y reported level at FL330 and never turned. Air carrier Y had reported 'traffic in sight' at the time of the reclrnc and this may have been a big factor in his lackluster performance to comply with control instructions. The actions to ensure separation were not timely enough as an ntap showed 1 DOT 1600 ft vertical and 4.65 NM lateral.

Title: ACR Y CLB THROUGH OCCUPIED ALT HAD LTSS FROM ACR Y. SYS ERROR.

Narrative: ACR X WAS ENRTE TO PDX AT FL350. ACR Y WAS ENRTE TO SAN AT FL330. ACR Y WAS CLBED TO FL370. WHEN PROX WAS NOTICED (15 SECONDS LATER), ACR Y WAS TURNED L AND TOLD TO MAINTAIN FL330. 2 1/2 MIN LATER, ACR Y RPTED LEVEL AT FL330 AND NEVER TURNED. ACR Y HAD RPTED 'TFC IN SIGHT' AT THE TIME OF THE RECLRNC AND THIS MAY HAVE BEEN A BIG FACTOR IN HIS LACKLUSTER PERFORMANCE TO COMPLY WITH CTL INSTRUCTIONS. THE ACTIONS TO ENSURE SEPARATION WERE NOT TIMELY ENOUGH AS AN NTAP SHOWED 1 DOT 1600 FT VERT AND 4.65 NM LATERAL.
