Narrative:
While passing through 16000 for 17000 assigned we were advised of traffic at 1 O'clock at 17000, eastbound. We spotted the small transport after the call at about 16300 and began to zero the rate of climb while questioning the altitude. The controller verified the small transport altitude of 17000 and asked us if we were level at 16000. Our reply was no we were climbing to an assigned altitude of 17000. The controller repeated 16000 and we descended to 16000. The small transport passed overhead when we were at 16200. The transition altitude from time of sighting went to about 16400 or 16500 where we initiated the 2000 FPM rate to 16000. Aircraft passed over at 16200. In that time period TCASII alerted us to slow descent which we had already initiated. The controller later questioned us as to our assigned altitude to which we agreed and replied 17000, what we had dialed in the preselector. I am quite confident that we were assigned 17000. Our flight plan route altitude is 16000 but we frequently are assigned different altitudes from the plan.

Narrative: WHILE PASSING THROUGH 16000 FOR 17000 ASSIGNED WE WERE ADVISED OF TFC AT 1 O'CLOCK AT 17000, EBOUND. WE SPOTTED THE SMT AFTER THE CALL AT ABOUT 16300 AND BEGAN TO ZERO THE RATE OF CLB WHILE QUESTIONING THE ALT. THE CTLR VERIFIED THE SMT ALT OF 17000 AND ASKED US IF WE WERE LEVEL AT 16000. OUR REPLY WAS NO WE WERE CLBING TO AN ASSIGNED ALT OF 17000. THE CTLR REPEATED 16000 AND WE DSNDED TO 16000. THE SMT PASSED OVERHEAD WHEN WE WERE AT 16200. THE TRANSITION ALT FROM TIME OF SIGHTING WENT TO ABOUT 16400 OR 16500 WHERE WE INITIATED THE 2000 FPM RATE TO 16000. ACFT PASSED OVER AT 16200. IN THAT TIME PERIOD TCASII ALERTED US TO SLOW DSCNT WHICH WE HAD ALREADY INITIATED. THE CTLR LATER QUESTIONED US AS TO OUR ASSIGNED ALT TO WHICH WE AGREED AND REPLIED 17000, WHAT WE HAD DIALED IN THE PRESELECTOR. I AM QUITE CONFIDENT THAT WE WERE ASSIGNED 17000. OUR FLT PLAN RTE ALT IS 16000 BUT WE FREQUENTLY ARE ASSIGNED DIFFERENT ALTS FROM THE PLAN.
