Narrative:
On departure from day, we were cleared to climb to 10000 ft on a 090 degree heading. After passing through 9300 ft we were given a TCASII TA followed by a TCASII RA to descend at 2000 FPM. We complied with the RA and descended until we were clear of conflict. A quick look outside showed that we were on a collision course with an medium large transport aircraft who was level at 10000 ft in a right turn at our 12 O'clock position. As we were taking evasive action, the controller gave us a turn to 060 degrees which would have put us even closer to the traffic. We advised ATC of our deviation so as to avoid the mlt aircraft. I do not know what happened from the controller's standpoint but I do know that we were assigned the same altitude.

Title: FLC OF MLG ACFT TOOK EVASIVE ACTION IN RESPONSE TO A TCASII RA AND STOPPED CLBING TO ASSIGNED DEP ALT. ACR ACFT HAD A NMAC WITH AN MLT ACFT.
Narrative: ON DEP FROM DAY, WE WERE CLRED TO CLB TO 10000 FT ON A 090 DEG HDG. AFTER PASSING THROUGH 9300 FT WE WERE GIVEN A TCASII TA FOLLOWED BY A TCASII RA TO DSND AT 2000 FPM. WE COMPLIED WITH THE RA AND DSNDED UNTIL WE WERE CLR OF CONFLICT. A QUICK LOOK OUTSIDE SHOWED THAT WE WERE ON A COLLISION COURSE WITH AN MLG ACFT WHO WAS LEVEL AT 10000 FT IN A R TURN AT OUR 12 O'CLOCK POS. AS WE WERE TAKING EVASIVE ACTION, THE CTLR GAVE US A TURN TO 060 DEGS WHICH WOULD HAVE PUT US EVEN CLOSER TO THE TFC. WE ADVISED ATC OF OUR DEV SO AS TO AVOID THE MLT ACFT. I DO NOT KNOW WHAT HAPPENED FROM THE CTLR'S STANDPOINT BUT I DO KNOW THAT WE WERE ASSIGNED THE SAME ALT.
