Narrative:
Cga X, an mdt, on IFR flight plan inbound to westchester county airport, was level at 3000 ft. VFR traffic, known to be at 2500 ft was issued to cga X. Cga X received a TCASII RA to climb, and did advise ATC. This RA resulted in cga X climbing into an IFR aircraft on vectors to lga airport and level at 4000 ft. Callback conversation with reporter revealed the following information: called reporter to get address and discuss incident. Reporter claims that he reported the incident to his supervisor and that a pilot deviation was filed because there was a loss of separation. Reporter understands that pilots are supposed to take action whenever the TCASII goes off, but thinks that something has to be changed with the equipment to prevent pilot action that actually creates a greater hazard. In this case, the traffic was issued and the pilot had the traffic in sight.

Title: CGA JET RESPONDING TO TCASII FROM A VFR ACFT, CLBS INTO AN IFR ACFT ABOVE, RESULTING IN LTSS.
Narrative: CGA X, AN MDT, ON IFR FLT PLAN INBOUND TO WESTCHESTER COUNTY ARPT, WAS LEVEL AT 3000 FT. VFR TFC, KNOWN TO BE AT 2500 FT WAS ISSUED TO CGA X. CGA X RECEIVED A TCASII RA TO CLB, AND DID ADVISE ATC. THIS RA RESULTED IN CGA X CLBING INTO AN IFR ACFT ON VECTORS TO LGA ARPT AND LEVEL AT 4000 FT. CALLBACK CONVERSATION WITH RPTR REVEALED THE FOLLOWING INFO: CALLED RPTR TO GET ADDRESS AND DISCUSS INCIDENT. RPTR CLAIMS THAT HE RPTED THE INCIDENT TO HIS SUPVR AND THAT A PLTDEV WAS FILED BECAUSE THERE WAS A LOSS OF SEPARATION. RPTR UNDERSTANDS THAT PLTS ARE SUPPOSED TO TAKE ACTION WHENEVER THE TCASII GOES OFF, BUT THINKS THAT SOMETHING HAS TO BE CHANGED WITH THE EQUIP TO PREVENT PLT ACTION THAT ACTUALLY CREATES A GREATER HAZARD. IN THIS CASE, THE TFC WAS ISSUED AND THE PLT HAD THE TFC IN SIGHT.
